Section 103-578; Ord. 17489; Rezoning Property Located on the Southwest Corner of Brown Station Road and Skyview Road from R-1 to O-P; Approving the Brown Station Early Learning Center O-P Plan

rezoning property located on the southwest corner of Brown Station Road and Skyview Road from District R-1 to District O-P; repealing all conflicting ordinances or parts of ordinances; approving the O-P Development Plan of Brown Station Early Learning Center; and fixing the time when this ordinance shall become effective.

SECTION 1. The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract located in part of the Southwest quarter of Section 32, Township 49 North, Range 12 West, City of Columbia, Boone County, Missouri, being Tract 2 as shown by the survey in Book 289 Page 360, and part of Tract A as shown by the survey in Book 297 Page 376, and being the tract described by the Deed in Book 1651 Page 351 and part of the tract described by the Deed in Book 631 Page 901, all of the Boone County Records, and being more particularly described as follows:

Beginning at the Northeast corner of said Tract 2; thence with the lines of said Tract 2, S 00E59'45" W, 100.85 feet; thence S 86E01'15" W, 159.35 feet; thence with the common line of said Tract 2 and Tract A, N 01E11'15" E, 21.45 feet; thence leaving the lines of said Tract 2 and Tract A, with a non-tangent curve to the right 42.71 feet, curve radius 36.00 feet, chord N 32E48'00" W, 40.25 feet; thence N 01E11'15" E, 40.55 feet to a point on the north line of said Tract A; thence with the north line of said Tract A, N 84E56'15" E, 22.65 feet to the Northwest corner of said Tract 2; thence leaving the north line of said Tract A and with the north line of said Tract 2, N 84E56'15" E, 159.30 feet to the point of beginning and contains 0.40 acre.

will be rezoned and become a part of District O-P (Planned Office District) and taken away from District R-1 (One-Family Dwelling District). Hereafter the property may be used for all the permitted uses in District R-1 and a day care center.

SECTION 3. The City Council hereby approves the Brown Station Early Learning Center O-P Development Plan, dated October 1, 2002, for the property referenced in Section 1 above. The Director of Planning and Development shall use the design parameters set forth in Exhibit A, which is attached to and made a part of this ordinance, as guidance when considering any future revisions to the O-P Development Plan.
