Section 103-608; Ord. 17508; Voluntary Annexation of Property Located at the NE Quadrant of the I-70/Lake of the Woods Road Interchange; Establishing Permanent C-P and C-3 Zoning

AN ORDINANCE

extending the corporate limits of the City of Columbia, Missouri, by annexing property located at the northeast quadrant of the I-70/Lake of the Woods Road Interchange; placing the property annexed in Districts C-P and C-3; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council hereby finds that verified petitions were filed with the City, requesting the annexation of land which is contiguous and compact to the existing corporate limits of the City and which is described in Section 4 of this ordinance.  The petitions were signed by the sole owners of the fee interest of record in the land proposed to be annexed and the City Manager as authorized by a previous annexation agreement.  A public hearing was held concerning this matter on November 4, 2002.  Notice of this hearing was published more than seven days prior to the hearing in two newspapers of general circulation qualified to publish legal matters.  At the public hearing all interested persons, corporations and political subdivisions were permitted to present evidence regarding the proposed annexation.
    SECTION 2.  The Council determines that the annexation is reasonable and necessary to the proper development of the City and that the City has the ability to furnish normal municipal services to the area to be annexed within a reasonable time.

    SECTION 3.  The Council determines that no written objection to the proposed annexation has been filed within fourteen days after the public hearing.

    SECTION 4.  The City Council hereby extends the city limits by annexing the land described in Section 1-11.101 of the Code of Ordinances of the City of Columbia, Missouri, which is hereby added to Chapter 1 of the City Code and which reads as follows:

    Section 1-11.101. November, 2002.  Extension of Corporate Limits.

    The corporate limits of the City of Columbia shall include the following land:

A tract of land in the northeast quarter of Section 10, Township 48 North, Range 12 West in Boone County, Missouri being described as all of Lake of the Woods North as recorded in Plat Book 33 at page 1, all of Lake of the Woods Center as recorded in Plat Book 33 at page 92, all of the land shown by the survey in Book 605 at page 499 and the tract described in the quit-claim deed in Book 443 at 543, EXCEPTING therefrom two (2) parcels in the northeast part of the last described tract, said parcels being those shown by the surveys in Book 882 at page 205 and in Book 974 at page 423, all of the Boone County Records.

    SECTION 5.  The City Clerk is hereby authorized and directed to cause three certified copies of this ordinance to be filed with the Clerk of Boone County, Missouri.

    SECTION 6.  The property described in Section 4 is in the Third Ward.

    SECTION 7.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is hereby amended and changed so that the following described property:

A tract of land in the northeast quarter of Section 10, Township 48 North, Range 12 West in Boone County, Missouri being described as all of Lake of the Woods North as recorded in Plat Book 33 at page 1, all of Lake of the Woods Center as recorded in Plat Book 33 at page 92 and all of the land shown by the survey in Book 605 at page 499, all of the Boone County Records and containing 22.42 acres.

will be rezoned and become a part of District C-3 (General Business District).

    SECTION 8.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is hereby amended and changed so that the following described property:
    
A tract of land in the east part of the northeast quarter of Section 10, Township 48 North, Range 12 West in Boone County, Missouri being described by the quit-claim deed recorded in Book 443 at page 543 and being the east 600 feet of the land shown by the survey in Book 256 at page 351, EXCEPTING therefrom the land described in the warranty deed in Book 881 at page 764 and shown by the survey in Book 882 at page 205 and ALSO EXCEPTING the land described in the warranty deed in Book 983 at page 894 and shown by the survey in Book 974 at page 423, all of the Boone County Records and containing 12.43 acres.

will be rezoned and become a part of District C-P (Planned Business District).  Hereafter the property may be used for all permitted uses in District C-1.

    SECTION 9.  This ordinance shall be in full force and effect from and after its passage.
