Section 103-609; Ord. 17509; Rezoning Property Located on the SE Corner of the Intersection of Rangeline/State Route 763 and Smiley Lane from M-C to C-P

Ordinance No.             17509             Council Bill No.           B 377-02            


rezoning property located on the southeast corner of the intersection of Rangeline/State Route 763 and Smiley Lane from District M-C to District C-P; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.


    SECTION 1.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land in the Northwest Quarter of Section 31, Township 49 North, Range 12 West in Columbia, Boone County, Missouri, being further described as Tract 1 of the survey recorded in Book 960 at Page 45 of the Boone County records excepting a 1 acre tract for a cemetery along the northerly side and excepting that portion of the right-of-way of American Parkway as shown by the final plat of 763 Business Park, Plat No. 1 as recorded in Plat Book 27 at Page 67 of the Boone County records and said tract containing approximately 22.27 acres.  

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District M-C (Controlled Industrial District).  Hereafter the property may be used for all the permitted uses in District C-1, car washes, service stations with car wash and lubrication facilities, medical and dental clinics and rental services.

    SECTION 2.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.  The rezoning of the property described in Section 1 shall be subject to the following conditions:

1.    A traffic study shall be provided at the time of the CP plan review.  The traffic study shall identify recommended access points and shall serve as the basis for an agreement among the Missouri Department of Transportation (MoDot), City and developer regarding developer’s responsibility for offsite improvements to Rangeline Street/State Route 763, American Parkway and Smiley Lane.  The CP site plan shall reserve an area along State Route 763 for future rightofway acquisition by MoDot.

As a result of the traffic study, the City may require that the total square footage and mix of nonresidential uses be adjusted or reduced from the initial development proposal to achieve the following:

Provide Level of Service (LOS) "C" at peak hour on weekdays and Saturdays at project build out and for each development phase.

Provide LOS "D" at peak hour on weekdays and Saturdays for 2020.

The traffic study shall identify offsite improvements needed to accommodate the traffic associated with the development at the desired LOS at each phase of development, at build out, and for 2020.  The traffic study shall include cost estimates for the improvements and the proposed funding sources.

2.    The developer shall enter into an agreement with the City and MoDot whereby the developer will be responsible for phased traffic improvements.

3.    A greenbelt buffer consisting of existing and additional trees sufficient to screen the adjacent residential development east of the subject tract shall be installed prior to any occupancy permits being granted.

4.    As per MoDot’s recommendation, no direct driveway access will be allowed from the subject tract onto Rangeline/State Route 763.  

5.    Driveway access from the subject tract onto Smiley Lane shall be located so as to not interfere with the signalized intersection at Smiley and Rangeline/State Route 763.  Driveway access from the subject tract onto American Parkway shall be located so as to not interfere with the required "stacking" area(s) within the turn lane(s) which may be required at this intersection.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage.
