Section 103-611; Ord. 17511; Vacating Street Right-of-Way for Hospital Drive

vacating street right-of-way for Hospital Drive; directing the City Clerk to have a copy of this ordinance recorded; accepting conveyance for emergency access and utility purposes; directing the City Clerk to have the conveyance recorded; and fixing the time when this ordinance shall become effective.

SECTION 1. The City Council finds and determines that a certain street right-of-way for Hospital Drive, between South College Avenue and Virginia Avenue, more particularly described as follows:

A tract of land located in the southwest quarter of Section 18 T48N R12W in Columbia, Boone County, Missouri, being part of the right-of-way of Hospital Drive (formerly Porter Street), as shown by the plat of Fairgrounds Addition, plat recorded in book 80 page 530, and part of right-of-way of Hospital Drive, shown by the plat of Virginia Field Subdivision, recorded in plat book 35 page 34.

Beginning at the southeast corner of Lot 1 Hospital Drive Subdivision, recorded in plat book 20 page 69, thence N 0E01'10"E, along the easterly line thereof, 11.80 feet to a corner of Lot 1 Virginia Field Subdivision, recorded in plat book 35 page 35; thence East, along the southerly line of said lot, 455.91 feet; thence leaving said line, South 61.80 feet to the southerly line of Hospital Drive (Porter Street); thence West, along said line, 455.93 feet; thence leaving said line, N 0E01'01"E 50.00 feet to the beginning and containing 28,176 square feet or 0.65 acre.

SECTION 2. The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

SECTION 3. The conveyance to the City of Columbia, Missouri, a municipal corporation, more particularly described as follows:

Grant of Easement from The Curators of the University of Missouri, dated September 23, 2002, more particularly described in Exhibit "A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

SECTION 4. The City Clerk is hereby authorized and directed to have the conveyance recorded in the office of the Boone County Recorder of Deeds.
