AN ORDINANCE

vacating a drainage easement located within Lot 292 of Smithton Ridge Subdivision, Plat 2; directing the City Clerk to have a copy of this ordinance recorded; accepting conveyance for drainage purposes; directing the City Clerk to have the conveyance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council finds and determines that a certain drainage easement located within Lot 292 of Smithton Ridge Subdivision, Plat 2, more particularly described as follows:

A strip of land described in the drainage easements recorded in Book 1275, Page 495; Book 1275, Page 520; Book 1278, Page 422; situated in the southwest quarter of Section 19, Township 48 North, Range 13 West, in the City of Columbia, Boone County, Missouri; and being shown on lot 292 of Smithton Ridge Plat 2 as recorded in Plat Book 33 at Page 63 and more particularly described as follows:  

Commencing at said northeast corner of Tract #1 of said survey in Book 279 at page 170 on the west right-of-way line; thence along the west right-of-way line, N3E57'20"W, 149.91 feet; thence on a curve to the right having a radius of 300.59 feet, a distance of 202.03 feet, the chord of said curve having bearing and distance of N15E17'50"E, 198.24 feet; thence N34E33'10"E, 796.03 feet; thence on a curve to the left having a radius of 277.12 feet, a distance of 164.72 feet, the chord of said curve having bearing and distance of N17E31'30"E, 162.30 feet; thence N0E29'50"E, 255.69 feet to the Point of Beginning of the second described parcel; thence continuing N0E29'50"E, 16.00 feet; thence N89E30'10"W, 62.00 feet; thence S0E29'50"W, 16.00 feet; thence S89E30'10"E, 62.00 feet to the Point of Beginning and containing 992 square feet.

is in excess and surplus to the needs of the City and is hereby vacated.

    SECTION 2.  The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 3.  The conveyance to the City of Columbia, Missouri, a municipal corporation, more particularly described as follows:

Grant of Easement for drainage purposes from Greenwing Development, LLC, dated November 21, 2002, more particularly described in Exhibit "A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

is hereby accepted.

    SECTION 4.  The City Clerk is hereby authorized and directed to have the conveyance recorded in the office of the Boone County Recorder of Deeds.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
