Section 104-073; Res. 30-03; Setting a Public Hearing RE: Construction of Sanitary Sewers in Sewer District No. 157 (Rollins and Burnam Avenue)

A RESOLUTION

declaring the necessity for construction of sanitary sewers in Sewer District No. 157 (Rollins & Burnam Avenue); stating the nature of and the estimate of the cost thereof; providing for payment for the improvement; providing for compliance with the prevailing wage law; and fixing the time for a public hearing thereon.

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council deems the construction of sanitary sewers, wye branches, manholes and other necessary appurtenances in Sewer District No. 157 necessary to the welfare and improvement of the City.

    SECTION 2.  The nature and scope of the improvement shall consist of furnishing all labor, materials, transportation, insurance and all other items, accessories and incidentals thereto necessary for the complete construction of the improvements.

    SECTION 3.  The estimated cost of this improvement is $ 82,300.00.

    SECTION 4.  Payment for this improvement shall be made by special tax bills evidencing special assessments levied and assessed against the lots, tracts or parcels of ground specially benefitted in Sewer District No. 157 of the City, in proportion to the area of the whole district exclusive of public highways, in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in a unit rate not to exceed $0.36 per square foot; and the balance from Sanitary Sewer Utility Funds and such other funds as may be lawfully appropriated or lawfully used for such purpose, the boundaries of the Sewer District No. 157 are described as follows:

A tract of land being part of Lots 6 through 9 and all of Lots 10 through 16 of La Grange Place as recorded in Plat Book 2 at Page 17 of the Boone County Records; situate in the City of Columbia, Boone County, Missouri and being further described as follows:

BEGINNING at the northwest corner of said Lot 9; thence along the north line of Lots 9 through 14 S.89E46'30"E., 380.24 feet to a point S.89E46'30"E., 19.50 feet from the northwest corner of said Lot 14; thence leaving said north line N.0E13'10"E., 55.00 feet; thence S.89E46'30"E., 195.50 feet to the east line of Lot 8; thence along said east line and the east line of said Lot 16 S.0E13'10"W., 235.00 feet to the southeast corner of said Lot 16; thence along the south line of said Lots 9 through 16 N.89E46'15"W., 578.53 feet to the east right-of-way line of Providence Road, also known as State Route 163; thence along said right-of-way line N.3E32'40"E., 10.58 feet; thence continuing along said right-of-way line along a curve to the left having a radius of 607.95 feet a distance of 95.92 feet (the chord of said curve having bearing and distance of N.1E02'15"W., 95.82 feet) to the west line of said Lot 9; thence along said west line N.3E32'40"E., 73.72 feet to the POINT OF BEGINNING and containing 2.63 acres.
    
    SECTION 5.  Any work done in connection with the construction of the improvement specified above shall be in compliance with the provisions of the prevailing wage laws of the State of Missouri.

    SECTION 6.  This resolution shall be published in a daily newspaper of general circulation in the City of Columbia for seven (7) consecutive insertions, and a public hearing in respect to this improvement will be held in the Council Chamber of the Daniel Boone Building, 701 E. Broadway, Columbia, Missouri, at 7 o'clock p.m., on February 17, 2003.
