determining that it is in the public interest to proceed with improvements to Flat Branch
Phase II; approving plans and specifications for the improvements; calling for bids through the
Purchasing Division; providing for payment for the improvement; appropriating funds; providing
for compliance with the prevailing wage law; and fixing the time when this ordinance shall
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
SECTION 1. After the adoption of a resolution by the City
Council, declaring the necessity
for improvements to Flat Branch Park Phase II, specifically the environmental cleanup of the
petroleum contamination under the existing parking lots, sidewalks and adjacent creek bed, and
after an advertised public hearing, the Council finds and determines that construction of such
improvements is necessary for the welfare and improvement of the city and that it is in the public
interest that such improvements be made.
SECTION 2. The plans and specifications for these improvements
filed in the office of the
city clerk, are hereby approved, adopted and made a part hereof by reference as fully as if set
forth herein verbatim.
SECTION 3. The City Manager, through the head of the Purchasing
Division, is hereby
authorized to call for bids for such improvements and to execute a contract for the improvement.
SECTION 4. Payment for this improvement shall be made
from the U.S. Environmental
Protection Agency Brownfields Cleanup Grant, Annual Park Improvement Funds, and such other
funds as may be lawfully appropriated.
SECTION 5. The sum of $40,000.00 is hereby appropriated
from the Federal Revenues
Account No. 440-0000-461.10-00 C00133 and $47,388.30 from the Federal Revenues Account
No. 440-0000-462.10-00 C40079 to the Flat Branch Park Phase II Account No. 440-8800-548.49-90 C00133.
SECTION 6. The City shall cause to be inserted into the
contract a stipulation to the effect
that not less than the prevailing hourly rate of wages, as found by the Department of Labor and
Industrial Relations of Missouri, shall be paid to all workers performing work under the contract.
The contractor's bond shall include such provisions as will guarantee the faithful performance of
the prevailing hourly wage clause, as provided by the contract. The City shall also cause to be
inserted into the contract a stipulation that all laborers and mechanics employed by the contractor
or subcontractors in the performance of work under the contract shall be paid wages at rates not
less than those prevailing on similar construction in the locality as determined by the Secretary of
Labor in accordance with the Davis-Bacon Act.
SECTION 7. This ordinance shall be in full force and effect
from and after its passage.
