A RESOLUTION

urging the Missouri Department of Natural Resources to take action quickly on applications for National Pollutant Discharge Elimination System permits in Columbia.

    WHEREAS, the Missouri Department of Natural Resources has failed to issue National Pollutant Discharge Elimination System (NPDES) permits for at least 23 construction projects in Columbia and Boone County; and

    WHEREAS, many of these construction projects are located in the Hinkson Creek Watershed and the City of Columbia supports construction that does not injure or degrade any creek; and

    WHEREAS, the Missouri Clean Water Commission has identified eleven miles of the Hinkson Creek in Boone County, under Section 303(d) of the Federal Water Pollution Control Act, as waters for which existing required pollution controls are not stringent enough to implement state water quality standards; and

    WHEREAS, the Department of Natural Resources has not yet established total maximum daily loads for Hinkson Creek and accordingly has not established any basis for denial of NPDES permits; and

    WHEREAS, the projects being delayed by the Department of Natural Resources’ failure to issue NPDES permits involve millions of dollars; and

    WHEREAS, the delay in acting on the permits adversely impacts economic development in the City of Columbia and adversely impacts the economic welfare of hundreds of construction workers; and

    WHEREAS, the Department of Natural Resources has not communicated the reasons for the delay to many of the property owners and developers.

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:
    SECTION 1. The City of Columbia strongly urges the Missouri Department of Natural Resources to either grant the pending NPDES permits in the Hinkson Creek Watershed or clearly state its reasons for not granting the permits and clearly identify the conditions under which the permits would be granted.
