AN ORDINANCE

rezoning property located on the south side of Vandiver Drive and on the west side of U.S. Highway 63 from Districts O-P and M-1 to District C-P; repealing all conflicting ordinances or parts of ordinances; approving the Bass Pro at CenterState Crossings C-P Development Plan; granting variances from the Subdivision Regulations; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District O-P (Planned Office District) and District M-1 (General Industrial District). Hereafter the property may be used for the following uses: retail sales and service; recreational vehicles, boat and trailer service and repair; restaurants, cafes and cafeterias; convenience stores with fuel pumps; and, outdoor displays and events.

    SECTION 2.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
    SECTION 3.  The City Council hereby approves the Bass Pro at CenterState Crossings C-P Development Plan dated February 6, 2004, for the property referenced in Section 1 above.  The Director of Planning and Development shall use the design parameters set forth in Exhibit A, which is attached to and made a part of this ordinance, as guidance when considering any future revisions to the C-P Development Plan.

    SECTION 4.  The approval of the C-P development plan is subject to the following conditions:

1.    At the time of final plat approval, the private streets shall be platted into a lot or lots to be owned by a property owners association which shall provide perpetual maintenance.

2.    The final plat shall name the private street between Vandiver Drive and Bass Pro Drive and show the lot west of Lake Ridgeway Road as “Not for Development.”

    SECTION 5.  The City Council grants a variance from the requirements of Section 25-26 of the Subdivision Regulations so that the drawing for the first sheet of the C-P development plan shall be at a scale of one inch equals 200 feet.

    SECTION 6.  The City Council grants a variance from the requirements of Section 25-48.1 of the Subdivision Regulations so that a sidewalk shall not be required along the west side of Lake Ridgeway Road subject to the condition that an 8-foot sidewalk be constructed along the east side of Lake Ridgeway Road.

    SECTION 7.  This ordinance shall be in full force and effect from and after its passage.
