Section 105-197; Ord. 18067; Rezoning property located between Leslie Lane and Texas Avenue, west of North Providence Road (State Route 163) from District R-1 to District C-P; approving the C-P Development Plan of Phoenix House

AN ORDINANCE

rezoning property located between Leslie Lane and Texas Avenue, west of North Providence Road (State Route 163) from District R-1 to District C-P; repealing all conflicting ordinances or parts of ordinances; approving the C-P Development Plan of Phoenix House; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

            
    SECTION 1.  The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

Lot 2 of H. E. Johnson Subdivision containing 3.9 acres as recorded in Book 18, Page 14 of the Deed Records of Boone County, Missouri.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District R-1 (One-Family Dwelling District).  Hereafter the property may be used for all permitted uses in District O-1 and the following uses:

    a.    Office for counselors and therapists and facilities for the counseling and rendering of psychological assistance to persons suffering from various mental and emotional illnesses;
    b.    Group facilities for education and therapy;
    c.    Group education facilities;
    d.    Residential facilities for the treatment of up to 35 persons who temporarily reside therein;
    e.    Recreational facilities for in-patients, out-patients and clients;
    f.    Kitchen facilities adequate to prepare three meals per day for the residents, staff and family members of residents;
    g.    Meeting facilities for community and therapy groups such as Alcoholics Anonymous and the like;
    h.    Facilities for meeting of family groups and extended family participants in the therapy and treatment of individuals; and
    i.    Administrative offices for persons engaged in the foregoing activities.

    SECTION 2.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.  The City Council hereby approves the Phoenix House C-P Development Plan, dated March 12, 2004, for the property referenced in Section 1 above. The Director of Planning and Development shall use the design parameters set forth in “Exhibit A” which is attached to and made a part of this ordinance as guidance when considering any future revisions to the C-P Development Plan.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage.
