AN ORDINANCE

abrogating the Final Plat of Scheulen Acres - Block V; directing the City Clerk to have a copy of this ordinance recorded; approving the Final Plat of Timber Creek, Plat No. 1; accepting the dedication of rights-of-way and easements; authorizing a performance contract; authorizing a development agreement; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Final Plat of Scheulen Acres - Block V, recorded in Plat Book 22, Page 16 of the Boone County, Missouri records, is hereby abrogated.
    
    SECTION 2.  The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 3.  The City Council hereby approves the Final Plat of Timber Creek, Plat No. 1, dated January, 2003, a major subdivision located on the west side of Stadium Boulevard (State Route E), south of Primrose Drive containing approximately 37.32 acres in the City of Columbia, Boone County, Missouri, and hereby authorizes and directs the Mayor and City Clerk to sign the plat evidencing such approval.

    SECTION 4.  The City Council hereby accepts the dedication of all rights-of-way and easements as dedicated upon the plat.

    SECTION 5.  The City Manager is hereby authorized to execute a performance contract with Timber Creek Condo Development, LLC in connection with the approval of the Final Plat of Timber Creek, Plat No. 1.  The form and content of the contract shall be substantially as set forth in "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 6.  The City Manager is hereby authorized to execute a development agreement with Timber Creek Condo Development, LLC in connection with the approval of the Final Plat of Timber Creek, Plat No. 1.  The form and content of the agreement shall be substantially as set forth in "Exhibit B" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 7.  This ordinance shall be in full force and effect from and after its passage.
