AN ORDINANCE

rezoning property located on the northwest corner of Stadium Boulevard (State Route 740) and Audubon Drive from District R-1 PUD to Districts C-P, O-P and PUD-4; repealing all conflicting ordinances or parts of ordinances; approving the C-P/O-P development plan and PUD site plan of Stratford Chase; granting variances to the Subdivision Regulations; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND LOCATED IN THE NORTHWEST QUARTER OF SECTION 20, TOWNSHIP 48 NORTH, RANGE 12 WEST, COLUMBIA, BOONE COUNTY, MISSOURI AND BEING A PART OF THE LAND DESCRIBED BY THE WARRANTY DEED RECORDED IN BOOK 1057, PAGE 566, AND BEING A PART OF THE LAND SHOWN IN THE SURVEY RECORDED IN BOOK 497, PAGE 159 AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

will be rezoned and become a part of District C-P (Planned Business District) and taken away from R-1 PUD (Planned Unit Development District).  Hereafter the property may be used for the permitted uses listed in “Exhibit A,” which is attached to and made a part of this ordinance to the extent such uses are allowed in District C-P.

will be rezoned and become a part of District PUD-4 (Planned Unit Development) with a development density not exceeding four dwelling units per acre and taken away from R-1 PUD (Planned Unit Development District).  The statement of intent, marked “Exhibit B,” is attached to and made a part of this ordinance.

    SECTION 4.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 5.  The City Council hereby approves the Stratford Chase C-P/O-P development plan and PUD-4 site plan, dated February 12, 2004, for the property referenced in Sections 1, 2 and 3 above.  The Director of Planning and Development shall use the design parameters set forth in “Exhibits C and D,” which are attached to and made a part of this ordinance, as guidance when considering any future revisions to the C-P/O-P development plan.  

    SECTION 6.  The approval of the development plan is subject to the following conditions:

    1.    That no restaurant exceed 2,500 square feet in size or have a drive-thru window and that no drug store or pharmacy exceed 3,750 square feet in size on the C-P zoned tract.

    2.    A pedestrian access way shall be constructed between the office area and the loop street across one of the dams of the detention ponds.

3.    The sign plan is amended as follows:

        (a)    The freestanding sign at the corner of Audubon and Stadium shall be a single face sign.

        (b)    The directional signs shall be no more than three feet in height.

        (c)    The freestanding building identification signs shall be no more than six feet in height.

    SECTION 7.  Subdivider is granted a variance from Section 25-47(a) of the Subdivision Regulations so that the maximum cul-de-sac length can be extended to 1,100 feet on Stratford Chase Parkway.

    SECTION 8.  Subdivider is granted a variance from Section 25-45(1) of the Subdivision Regulations so that Stratford Chase Circle can be constructed with a centerline radius of 85 feet.

    SECTION 9.  Subdivider is granted a variance from Section 25-51 of the Subdivision Regulations so that a sidewalk shall not be required along the Stadium Boulevard (State Route 740) frontage.

    SECTION 10.  This ordinance shall be in full force and effect from and after its passage.
