A RESOLUTION

declaring the necessity for the construction of an 8-inch water main serving Dakota Ridge, Plat 1; stating the nature of the improvement; estimating the extra cost for constructing an 8-inch rather than a 6-inch water main; providing that the improvement shall be made by Dakota Ridge, LLC; and setting a public hearing.

WHEREAS, Dakota Ridge, LLC desires to install a 6-inch water main to serve property abutting the proposed water main extension; and

WHEREAS, the City for reasons of health, safety, public welfare, and future adequate service to areas other than Dakota Ridge, Plat 1, requires that an 8-inch water main be installed; and

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:
SECTION 1.  The Council deems the construction of about 1,045 feet of 8-inch water main pipes and accessory valves and fittings serving Dakota Ridge, Plat 1 necessary to assure adequate future water supply for the health, safety and welfare of the citizens of the City.

SECTION 2.  The nature and scope of the improvement shall consist of furnishing all labor, materials, transportation, insurance and all other items necessary for the complete construction of the water main described in Section 1.

SECTION 3.  The estimated differential cost for an 8-inch water main (the cost of constructing an 8-inch water main which exceeds the cost of constructing a 6-inch water main) for this improvement is $ 4.39 per linear foot.

SECTION 4.  This improvement shall be made by Dakota Ridge, LLC.

SECTION 5.  This resolution shall be published in a daily newspaper of general circulation in the City of Columbia for seven (7) consecutive insertions, and a public hearing in respect to this improvement will be held in the Council Chamber of the Daniel Boone Building, 701 E. Broadway, Columbia, Missouri, at 7:00 p.m., on June 7, 2004.

ADOPTED this 17th day of May, 2004.
