AN ORDINANCE

rezoning property located on the northeast side of Bear Creek and at the west terminus of Big Bear Boulevard from District R-1 to Districts A-1 and M-R; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

An irregular shaped parcel of land across a tract of land described in an estate deed in Book 404, Page 181 of the records of Boone County, Missouri; situated in the northwest quarter of Section 1, Township 48 North, Range 13 West, Boone County, Missouri and more particularly described as follows.

Commencing at the Northwest corner of the Northeast quarter of Section 1, Township 48 North, Range 13 West, thence along the North line of said Section N89°32’30”W, 805.20 feet to the Point of Beginning; thence S36°04’20”E, 791.27 feet; thence S25°54’35”E, 477.37 feet; thence S54°12’10”E, 237.06 feet to the West line of North 63 Industrial Park Plat No. 2 as recorded in Plat Book 18, Page 46 of the records of Boone County, Missouri; thence along said West line S4°08’10”E, 213.77 feet to the Southwest corner of said Plat No. 2; thence along the prolongation of the Southwesterly line of said Plat No. 2 N71°36’50”W, 27.56 feet; thence N51°37’55”W, 526.53 feet; thence N56°14’35”W, 145.84 feet to the Easterly corner of Lot 11 of Parkade Estates Block II as recorded in Plat Book 8, Page 26 of the records of Boone County, Missouri; thence along the lines of said Parkade Estates Block II the following bearings and distances, N32°24’40”W, 289.97 feet, N25°25’55”W, 245.69 feet, N37°22’55”W, 176.58 feet to the Northeast corner of said Parkade Estates Block II; thence along the South line of Parkade Estates North as recorded in Plat Book 24, Page 44 of the records of Boone County, Missouri, S88°45’10”E, 8.58 feet to the southeast corner of said Parkade Estates North; thence along the east line of said Parkade Estates North, N23°32’55”W, 435.40 feet to the north line of said Section 1; thence along said North line S89°32’30”E, 211.55 feet to the point of beginning and containing 9.18 acres.

will be rezoned and become a part of District A-1 (Agricultural District) and taken away from District R-1 (One-Family Dwelling District).

Commencing at the Northwest corner of the Northeast quarter of Section 1, Township 48 North, Range 13 West; thence along the North line of said Section N89°32’30”W, 805.20 feet to the Point of Beginning; thence E36°04’20”E, 791.25 feet; thence S25°54’35”E, 477.37 feet; thence S54°12’10”E, 237.06 feet to the West line of North 63 Industrial Park Plat No. 2 as recorded in Plat Book 18, Page 46 of the records of Boone County, Missouri; thence along said West line N4°08’10”W, 1204.49 feet to the Northwest corner of North 63 Industrial Park Administrative Subdivision Replat as recorded in Plat Book 20, Page 20 of the records of Boone County, Missouri, said point also being on the north line of Section 1; thence along said North line N89°32’30”W, 779.91 feet to the point of beginning and containing 11.27 acres.

will be rezoned and become a part of District M-R (Research, Development and Office Park District) and taken away from District R-1 (One-Family Dwelling District).  Hereafter the property may be used for retail establishments provided such establishments are ancillary to a warehousing or distributing facility and all allowed M-C uses except for the following: automobile repair facilities, freight terminals, restaurants and tree trimming and removal services.
                            
    SECTION 3.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage.
