Section 105-249; Ord. 18099; Rezoning property located on the east side of North Providence Road (State Route 163), between Dysart Avenue and Pecan Street from District R-3 to District C-P; approving the C-P development plan of Kilgore’s Pharmacy

AN ORDINANCE

rezoning property located on the east side of North Providence Road (State Route 163), between Dysart Avenue and Pecan Street from District R-3 to District C-P; repealing all conflicting ordinances or parts of ordinances; approving the C-P development plan of Kilgore’s Pharmacy; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land located in the Northeast quarter of Section 12, Township 48 North, Range 13 West, Boone County, Missouri being part of Dysart’s Addition to Columbia as recorded in Book 84 at Page 30 of the records of Boone County and more particularly described as follows:

Lots 17, 31, 32, and including two strips of land for an alley between lots 17 and 32 and the west half of the alley between lots 18 and 31; all of Dysart’s Addition to Columbia.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District R-3 (Medium Density Multiple-Family Dwelling District).  Allowed uses shall be a pharmacy, including all accessory retail sales and uses typical of a pharmacy and all permitted uses in District C-1 except those exceptions listed in “Exhibit A,” attached hereto and incorporated herein by reference.  The Council recognizes that many of the uses listed as exceptions in Exhibit A, which was submitted on behalf of the property owner, are not actually permitted uses in District C-1.
 
    SECTION 2.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.  The City Council hereby approves the Kilgore’s Pharmacy C-P development plan dated March 12, 2004.  The Director of Planning and Development shall use the design parameters set forth in “Exhibit B” which is attached to and made a part of this ordinance as guidance when considering any future revisions to the C-P Development Plan.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage.
