Section 105-277; Ord. 18113; Rezoning property located on the south side of Vandiver Drive, west of U.S. Highway 63 from District O-P to District C-P; approving the C-P development plan of MV Properties at Centerstate Crossings

AN ORDINANCE

rezoning property located on the south side of Vandiver Drive, west of U.S. Highway 63 from District O-P to District C-P; repealing all conflicting ordinances or parts of ordinances; approving the C-P development plan of MV Properties at Centerstate Crossings; approving a reduced number of parking spaces; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND LOCATED IN SECTION 5, TOWNSHIP 48 NORTH, RANGE 12 WEST, COLUMBIA, BOONE COUNTY, MISSOURI AND BEING A PART OF THE LAND DESCRIBED BY THE WARRANTY DEEDS RECORDED IN BOOK 1559, PAGE 644 AND BOON 1580, PAGE 870 AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

COMMENCING AT THE CENTER OF SAID SECTION AS SHOWN IN THE SURVEY RECORDED IN BOOK 2133, PAGE 637, THENCE WITH THE EAST LINE OF LOT 20 AS SHOWN ON CENTERSTATE PLAT 1 RECORDED IN PLAT BOOK 35, PAGE 33, N0°28’15”E, 763.62 FEET TO THE SOUTH RIGHT-OF-WAY OF VANDIVER DRIVE; THENCE WITH SAID SOUTH RIGHT-OF-WAY 44.34 FEET ALONG A 900-FOOT RADIUS NON-TANGENT CURVE TO THE LEFT, SAID CURVE HAVING A CHORD OF N52°59’40”E, 44.33 FEET; THENCE N51°35’00”E, 493.41 FEET TO THE POINT OF BEGINNING;

THENCE FROM THE POINT OF BEGINNING, CONTINUING ALONG SAID RIGHT-OF-WAY N51°35’00”E, 396 FEET; THENCE LEAVING SAID RIGHT-OF-WAY S38°26’55”E, 580.00 FEET; THENCE S51°35’00”W, 396.00 FEET; THENCE N38°26’55”W, 580.00 FEET TO THE POINT OF BEGINNING AND CONTAINING 5.27 ACRES EXCEPT THE PART PRESENTLY ZONED C-P.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from O-P (Planned Office District).  Hereafter the property may be used for all permitted uses in District C-3 except the following: halfway houses, farm machinery sales and services, drive-in theaters and machine shops.

    SECTION 2.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.  The City Council hereby approves the MV Properties at Centerstate Crossings C-P development plan, dated April 28, 2004, for the property referenced in Section 1 above.  The Director of Planning and Development shall use the design parameters set forth in Exhibit A, which is attached to and made a part of this ordinance, as guidance when considering any future revisions to the C-P Development Plan.

    SECTION 4.  The City Council approves a reduction in the number of required off-street parking spaces so that only the 300 spaces shown on the plan shall be required.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
