AN ORDINANCE
declaring it is in the public interest to proceed with construction of improvements to the Martin Luther King, Jr. Memorial at Battle Garden; approving plans and specifications for the improvements; calling for bids through the Purchasing Division; determining that a portion of the work shall be done by City employees; providing for payment for the improvement; appropriating funds; authorizing the City Manager to execute an agreement with the United States Department of the Interior National Park Service; and fixing the time when this ordinance shall become effective.

    WHEREAS, the City Council adopted a resolution declaring the necessity of constructing improvements to the Martin Luther King, Jr. Memorial at Battle Garden; and

    WHEREAS, the resolution was published in a daily newspaper of general circulation in the city; and

    WHEREAS, the City Council has held a public hearing on construction of the improvement.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council finds that construction of improvements to the Martin Luther King, Jr. Memorial at Battle Garden, including the testing and study of conservation treatments, restoration of tile on the Memorial, construction of an interpretive shelter, creation of ADA parking spaces and walkway, and installation of interpretive signs, is necessary for the welfare and improvement of the City and that it is in the public interest that such improvements be made.

    SECTION 2.  The plans and specifications for this improvement as prepared by the Department of Parks and Recreation and filed in the office of the City Clerk, are hereby approved, adopted and made a part hereof by reference as fully as if set forth herein verbatim.

    SECTION 3.  The City Manager, through the head of the Purchasing Division,  is hereby authorized to call for bids and award a contract for the construction of a new shelter.  As deemed advisable by the City Manager, City employees shall be used to construct the other improvements.

    SECTION 4.  Payment for this improvement shall be made from National Park Service Grant Funds, Park Sales Tax Funds, private donations, and such other funds as may be lawfully appropriated.

    SECTION 5.  The sum of $ 98,768.00 is hereby appropriated from Federal Grant Revenue Account No. 440-0000-461.10-00 C00067 and the sum of $ 11,000.00 is appropriated from the Annual Park Improvement Fund Account No. 440-8800-548.49-90 C00056 to the MLK Restoration Account No. 440-8800-548.49-90 C00067.

    SECTION 6.  The City Manager is hereby authorized to execute a grant agreement with the United States Department of the Interior National Park Service for a Save America’s Treasures Grant.  The form and content of the agreement shall be substantially as set forth in "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 7.  This ordinance shall be in full force and effect from and after its passage.
