AN ORDINANCE

establishing a moratorium on the demolition and removal of buildings in the Columbia Special Business District; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1. The City Council finds that it is in the public interest to have a downtown business district composed of dense commercial developments with a minimum of vacant lots and surface parking lots.  The City Council further finds that there has been a problem in downtown Columbia with buildings being torn down to make way for surface parking lots.  The City Council intends to study the matter and consider passage of an ordinance regulating the demolition and removal of buildings in downtown Columbia.  The purpose of this ordinance is to limit the demolition of buildings in the downtown area while the City develops regulations pertaining to the demolition and removal of buildings in the downtown area.  

    SECTION 2.  No permits for the demolition or removal of a building within the boundaries of the Columbia Special Business District shall be issued from the passage of this ordinance until November 16, 2004 except as provided in Section 3.

    SECTION 3.  The City Council may, by resolution, allow the issuance of a permit for the demolition or removal of a building within the boundaries of the Columbia Special Business District under any of the following circumstances:

(a)    The Council is satisfied that the building to be demolished or removed would be replaced with an acceptable replacement building.

(b)    The building to be demolished is a dangerous structure.

(c)    The Council determines that failure to allow demolition or removal of the structure would cause a substantial economic hardship on the property owner.

(d)    The Council determines that demolition or removal of the building would not interfere with the goal of having a downtown business district composed of dense commercial development with a minimum of vacant lots and surface parking lots.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage and shall remain in effect until November 16, 2004.
