AN ORDINANCE

rezoning property located on the north side of Smiley Lane, west of Arctic Fox Drive from Districts R-1 and C-3 to District PUD-9; repealing all conflicting ordinances or parts of ordinances; approving the PUD site plan of Brookside Square; granting variances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land located in the Southwest quarter of Section 25, Township 49 North, Range 13 West, Boone County, Missouri; Being described by the quit claim deed as recorded in Book 1565 at Page 985 of the records of Boone County and more particularly described as follows:

Commencing at the south quarter corner of Section 25-49-13; thence along the south section line of said section, N87°07’00”W, 764.87 feet; thence leaving said line, N02°53’00”E, 33.00 feet to the Point of Beginning, said point also lying on the north line of a street easement as recorded in Book 509 at Page 787; thence N87°07'00"W, 530.00 feet; thence N02°52'49"E, 324.95 feet; thence N87°07'11"W, 160.00 feet; thence N02°52'49"E, 180.00 feet; thence S87°07'11"E, 688.87 feet; thence S01°25'59"E, 15.04 feet; thence S02°52'49"W, 489.97 feet to the Point of Beginning and containing 6.80 acres.

will be rezoned and become a part of District PUD (Planned Unit Development) with a development density not exceeding nine dwelling units per acre and taken away from District R-1 (One-Family Dwelling District) and District C-3 (General Business District).  The zoning district map shall designate the property PUD-9.  Hereafter the property may be used for all permitted uses in District R-3 and single family attached townhomes.  The Statement of Intent, marked "Exhibit A" is attached to and made a part of this  ordinance.

    SECTION 2.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.  The City Council hereby approves the Planned Unit Development Site Plan of Brookside Square PUD dated June 24, 2004.

    SECTION 4.  Approval of the PUD Site Plan shall be deemed to satisfy the requirements for a Preliminary Plat of a Subdivision.

    SECTION 5.  Approval of the PUD Site Plan is subject to the subdivider designing and installing traffic calming devices on Corcoran Drive subject to the approval of the Director of Public Works.

    SECTION 6.  Subdivider is granted a variance from the requirements of Section 25-46(e) so that Sullivan Street may be constructed with an offset of less than 125 feet from Arctic Fox Drive.

    SECTION 7.  Subdivider is granted a variance from the design standards for alleys so that the alley north of Corcoran Drive may be constructed at a length of 650 feet.

    SECTION 8.  This ordinance shall be in full force and effect from and after its passage.
