Ordinance No.            018248                      Council Bill No. B 308-04            

authorizing an agreement with Bristol Lake Investments, LLC, B & E Investments, Inc., Bristol 124, LLC and Bristol 6789, LLC for purchase of a portion and donation of another portion of the Philips Farm tract on the southwest side of U.S. 63 north of Gans Road and related matters; directing the City Clerk to have the agreement recorded; appropriating funds; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Manager is hereby authorized to execute the Philips Farm Agreement with Bristol Lake Investments, LLC, B & E Investments, Inc., Bristol 124, LLC and Bristol 6789, LLC.  The form and content of the agreement shall be substantially as set forth in "Attachment A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 2.  The City Clerk is authorized and directed to have the agreement recorded in the office of the Boone County Recorder of Deeds.

    SECTION 3.  The sum of $650,000 is hereby appropriated from the Parks Sales Tax Account No. 220-0000-341.10-00 and $650,000 is hereby appropriated from the Accumulated Investment Income Account No. 440-0000-341.10-00 C40500 to the Philips Property Account No. 440-8800-548.49-90 C00181.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage.
