AN ORDINANCE

rezoning property located on the north side of Green Meadows Road, approximately 100 feet east of Skylark Drive from District R-1 to District PUD-3; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:
    SECTION 1.  The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land located in the Northwest quarter of Section 25, and the Northeast quarter of section 26, Township 49 North, Range 13 West, Boone County, Missouri being part of a survey as recorded in Book 479 at Page 563 of the records of Boone County and more particularly described as follows:

Beginning at the Northwest corner of a survey as recorded in Book 414 at Page 275; thence along the west line of said survey, S2°06’00”W, 210.55 feet; thence N88°57’00”W, 37.05 feet; thence S02°06’00”W, 224.72 feet to the south line of a survey as recorded in Book 479 at Page 563; thence along said line, N88°57’00”W, 336.72 feet to the west line of said survey, said point also being the east line of Green Meadows Subdivision Plat 3 as shown in Plat Book 28 at Page 93; thence along said line, N0°39’00”W, 823.09 feet to the south line of a survey recorded in Book 741 at Page 236; thence along said line, S79°00’00”E, 227.66 feet to the south line of Trail Ridge Subdivision Block 2 as recorded in Plat Book 18 at Page 13; thence along said line, S67°04’00”E, 109.75 feet to the west right-of way line of Trail Ridge Drive; thence S79°03’00”E, 50.00 feet to the east right-of-way line of said street; thence along said line, N10°56’45”E, 49.14 feet to the southwest corner of lot 3 of Trail Ridge Subdivision Block 2 as recorded in Plat Book 18 at Page 13; thence S76°37’00”E, 128.45 feet to the southeast corner of said lot; thence along the east line of said lot, N10°29’00”E, 119.40 feet to the northeast corner of said lot; thence N27°14’00”E, 76.35 feet to the Southwest corner of lot 4 of Trail Ridge Subdivision Block 1 as recorded in Plat Book 15 at Page 34; thence along the south line of said plat, S82°36’00”E, 258.90 feet; thence N89°21’00”E, 89.20 feet; thence S84°36’00”E, 30.00 feet; thence S5°24’00”W, 444.48 feet to the north line of the survey as recorded in Book 658 at Page 587; thence along said line, N87°30’00”W, 112.60 feet to the northwest corner of said survey; thence along the west line of said survey, S01°00’10”E, 42.00 feet to the north line of the survey recorded in Book 414 at Page 275; thence along the north line of said survey, N88°16’00”W, 388.00 feet to the point of beginning and containing 12.10 acres.

will be rezoned and become a part of District PUD-3 (a Planned Unit Development having a development density of not more than three dwelling units per acre) and taken away from District R-1 (One Family Dwelling District).  Hereafter the property may be used for detached single family residences and attached, zero lot line single family residences with no more than two dwelling units being attached to each other.  The Statement of Intent, marked “Exhibit A” is attached to and made a part of this  ordinance.

    SECTION 2.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.  The rezoning of the property described in Section 1 shall be subject to the following conditions:

    1.    A storm water management plan shall be required at the time of PUD site plan submittal.  Such plan shall mitigate the increase in runoff generated by the development in excess of an R-1 single family subdivision.

    2.    A landscape buffer shall be provided along the west side of the three lots immediately north of Green Meadows Road, which abut the single family homes on Skylark Drive.  The screen, which shall be required at the time of PUD site plan review, shall provide 80 percent opacity all year.

    3.    Except as modified by this ordinance, the PUD development shall be subject to the conditions, requirements, restrictions and descriptions set forth in Exhibit A and in the documentation which was provided by applicant’s attorney (a two page letter dated May 14, 2004 and a 13 page memorandum with exhibits dated May 13, 2004), marked “Exhibit B,” attached to and made a part of this  ordinance.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage.
