AN ORDINANCE

approving the Ruby Tuesday C-P Development Plan; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council hereby approves the Ruby Tuesday C-P Development Plan, dated November 5, 2004, located on the west side of U.S. Highway 63 and south of Vandiver Drive.  The Director of Planning and Development shall use the design parameters set forth in “Exhibit A” which is attached to and made a part of this ordinance as guidance when considering any future revisions to the C-P Development Plan.

    SECTION 2.  Approval of the C-P Development Plan shall be deemed to satisfy the requirements for a Preliminary Plat of a Subdivision.

    SECTION 3.  Approval of the C-P Development Plan is subject to the following conditions:

    a)    The on-site lighting standards shall be 20 feet in height with full cutoff shoebox type fixtures.

    b)    The proposed 30-foot tall pylon sign shall be eliminated.

    c)    A monument sign with 24 square feet of surface area (each side) shall be allowed in place of the pylon sign.

    SECTION 4.  This ordinance shall be in full force and effect from and
after its passage.
