A RESOLUTION

granting a permit to remove that portion of the downtown canopy located in front of 1025 E. Broadway, subject to conditions.

    WHEREAS, Chapter 6, Article II, Section 6-17 of the City Code amending Section 3202.5 of the 2000 Edition of the International Building Code provides, in part, that a permit to remove the downtown canopy must be obtained from the City Council prior to removal; and

    WHEREAS, Charles W. and Sue E. Franklin have requested approval of the City Council to remove that portion of the downtown canopy located in front of their building at 1025 E. Broadway, Columbia, Missouri; and

    WHEREAS, the Metropolitan Improvement Corporation, owner of the downtown canopy, consents to removal of the canopy located in front of 1025 E. Broadway.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City of Columbia hereby grants Charles W. and Sue E. Franklin a permit to remove the section of the downtown canopy located in the public right-of-way at 1025 E. Broadway, in accordance with Chapter 6, Article II, Section 6-17 of the City Code amending Section 3202.5 of the 2000 Edition of the International Building Code, provided that:

    A.    Approval of the Public Works Department of its plans for removal including, but not limited to, the manner of removal and support and finishing of the remaining canopy which it adjoins; and

    B.    Approval of the Water and Light Department of provisions for street lighting and other electrical facilities formerly housed or connected to the canopy to be removed.
