rezoning approximately 0.32 acre of property located on the east side of Providence
north of Campusview Drive from District A-1 to District C-P; approving the Providence Home
Center C-P Development Plan; setting forth conditions of approval; granting a variance relating
to sidewalk construction; repealing all conflicting ordinances or parts of ordinances; and fixing
the time when this ordinance shall become effective.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
SECTION 1. The Zoning District Map established and adopted
by Section 29-4 of the Code
of Ordinances of the City of Columbia, Missouri, is amended so that the following property:
A TRACT OF LAND LOCATED IN THE SOUTHWEST QUARTER OF SECTION 24,
TOWNSHIP 48 NORTH, RANGE 13 WEST, COLUMBIA, BOONE COUNTY, MISSOURI
AND BEING THE LAND DESCRIBED IN THE DEED RECORDED IN BOOK 2578, PAGE
127 OF RECORDS OF BOONE COUNTY AND BEING MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHWEST CORNER OF COLLEGE PARK SOUTH PLAT 1,
RECORDED IN PLAT BOOK 23, PAGE 56, SAID POINT BEING THE CENTERLINE OF
CARTER LANE AND 41.89 FEET EAST OF A POINT 175.00 FEET LEFT OF CENTERLINE
STATION 161+35.00 OF PROVIDENCE ROAD; THENCE LEAVING THE CENTERLINE
OF CARTER LANE AND THE LINES OF COLLEGE PARK SOUTH PLAT 1, S84º0930W,
41.89 FEET TO A POINT 175 FEET LEFT OF SAID STATION 161 + 35.00; THENCE WITH
SAID STATION S46°5020W, 102.83 FEET TO THE EASTERLY RIGHT-OF-WAY OF
PROVIDENCE ROAD; THENCE WITH SAID EASTERLY RIGHT-OF-WAY, 155.64 FEET
ALONG A NON-TANGENT SPIRAL CURVE TO THE LEFT, SAID CURVE HAVING A
CHORD, N45°1255W, 155.50 FEET TO A POINT OF 75 FEET LEFT OF T. S. STATION
159 + 79.47; THENCE N46°5800W, 9.46 FEET TO THE SOUTH LINE OF LOT 1 OF FIRST
MET PLAT 1; THENCE LEAVING SAID RIGHT-OF-WAY AND WITH THE LINES OF
SAID LOT 1, S88°5850E, 229.97 FEET TO THE CENTERLINE OF CARTER LANE AND
THE WEST LINE OF AFORESAID COLLEGE PARK SOUTH PLAT 1; THENCE WITH THE
WEST LINE OF SAID PLAT S6º1005E, 37.52 FEET TO THE POINT OF BEGINNING AND
CONTAINING 0.32 ACRES.
will be rezoned and become a part of District C-P (Planned Office District) and taken
District A-1 (Agricultural District). Hereafter, the property may be used for all permitted uses
Districts O-1 and O-2 and barber and beauty shops.
SECTION 2. The City Council hereby approves the Providence
Home Center C-P
Development Plan dated October 21, 2004, for property located on the east side of Providence
Road and north of Campusview Drive. The Director of Planning and Development shall use the
design parameters set forth in Exhibit A, which is attached to and made part of this ordinance,
as guidance when considering any future revisions to the C-P Development Plan.
SECTION 3. Approval of the C-P Plan shall be deemed to
satisfy the requirements for a
Preliminary Plat of a Subdivision.
SECTION 4. The approval of this C-P Development Plan is
subject to the following
(1) On-site lighting standards shall
be limited to a maximum of 20 feet in height.
(2) Wall-pack lights shall not be used.
(3) That section of Carter Lane, from
Campusview Drive to the north boundary of the
subject site, shall be improved to City local residential standards prior to an occupancy permit
being granted for the office/commercial building. The improvements shall include any segment
of Carter Lane south of the subject site and north of Campusview Drive that has no pavement
SECTION 5. Subdivider is granted a variance from the requirements
of Section 25-48.1 of the
Subdivision Regulations so that a sidewalk shall not be required along Providence Road, adjacent
to the southern 0.32 acres.
SECTION 6. All ordinances or parts of ordinances in conflict
with the provisions of this
ordinance are hereby repealed.
SECTION 7. This ordinance shall be in full force and effect
from and after its passage.
