AN ORDINANCE

rezoning property located on the south side of I-70 Drive Southeast, west of Eastland Hills Subdivision from District A-1 to District R-1; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 9, TOWNSHIP 48 NORTH, RANGE 12 WEST, COLUMBIA, BOONE COUNTY, MISSOURI BEING A PART OF TRACT 3 SHOWN BY THE SURVEY RECORDED IN BOOK 453, PAGE 849 AND BEING PART OF THE TRACT  DESCRIBED BY THE TRUSTEES DEED RECORDED IN BOOK 2490, PAGE 101 AND BEING FURTHER DESCRIBED AS FOLLOWS:

BEGINNING AT THE EAST QUARTER CORNER OF SAID SECTION 9; THENCE WITH THE SOUTH LINE OF THE NORTHEAST QUARTER OF SAID SECTION, S87°29’50”W, 1476.11 FEET TO THE SOUTHWEST CORNER OF THE SURVEY RECORDED IN BOOK 453, PAGE 849; THENCE LEAVING SAID SOUTH LINE AND WITH THE WEST LINE OF SAID SURVEY, N0°02’40”E, 833.69 FEET; THENCE LEAVING SAID WEST LINE, S86°29’40”E, 310.48 FEET; THENCE S89°56’10”E, 200.00 FEET; THENCE N50°06’50”E, 512.15 FEET; THENCE N19°49’45”E, 298.75 FEET TO THE SOUTH RIGHT-OF-WAY LINE OF STATE ROUTE 40 AS DESCRIBED IN THE DEED RECORDED IN ROAD BOOK 1, PAGE 80; THENCE WITH SAID RIGHT-OF-WAY LINE, N71°54’45”E, 82.28 FEET TO A POINT 140.00 FEET RIGHT OF AND PERPENDICULAR TO CENTERLINE STATION 909+00; THENCE PERPENDICULAR TO SAID CENTERLINE AT SAID STATION, N18°05’15”W, 80.00 FEET TO THE SOUTH RIGHT-OF-WAY LINE OF STATE ROUTE 40 AS DESCRIBED BY THE CONDEMNATION CASE #29229; THENCE WITH SAID SOUTH RIGHT-OF-WAY LINE, N71°54’45”E, 67.03 FEET TO A POINT 163.97 FEET RIGHT OF STATION 901+50 OF INTERSTATE 70 AS DESCRIBED IN THE DEED RECORDED IN ROAD BOOK 2, PAGE 441; THENCE PERPENDICULAR TO THE CENTERLINE OF INTERSTATE 70 AT SAID STATION S1°21’10”W, 6.03 FEET TO THE SOUTH RIGHT-OF-WAY TO INTERSTATE 70, SAID POINT BEING 170.00 FEET RIGHT OF CENTERLINE STATION 901+50 AS DESCRIBED IN THE DEED RECORDED IN ROAD BOOK 2, PAGE 441; THENCE WITH SAID SOUTH RIGHT-OF-WAY LINE, N80°02’30”E, 254.95 FEET TO A POINT 120.00 FEET RIGHT OF STATION 904+00; THENCE CONTINUING WITH SAID RIGHT-OF-WAY, S88°38’50”E, 88.99 FEET TO THE NORTHEAST CORNER OF THE SURVEY RECORDED IN BOOK 453, PAGE 849, SAID POINT BEING ON THE EAST LINE OF SAID SECTION 9; THENCE WITH THE LINES OF SAID SURVEY AND THE EAST LINE OF SAID SECTION S0°29’00”E, 1517.90 FEET TO THE POINT OF BEGINNING AND CONTAINING 36.79 ACRES.

will be rezoned and become a part of District R-1 (One-Family Dwelling District) and taken away from District A-1 (Agricultural District).

    SECTION 2.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.  This ordinance shall be in full force and effect from and after its passage.
