AN ORDINANCE

vacating sewer utility easements in conjunction with the Replat of Smithton Ridge Plat 4-A; directing the City Clerk to have a copy of this ordinance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council finds and determines that certain sewer utility easements, more particularly described as follows:

    LEGAL DESCRIPTION (LINE D)
    SEWER EASEMENT VACATION

A 16 FOOT WIDE STRIP OF LAND DESCRIBED AS LINE D AND LOCATED IN THE SOUTH HALF OF SECTION 9, TOWNSHIP 48 NORTH, RANGE 13 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, BEING PART OF LOT 1 OF SMITHTON RIDGE PLAT 4 AS RECORDED IN PLAT BOOK 34, PAGE 53; ALSO BEING PART OF THE SANITARY SEWER EASEMENT RECORDED IN BOOK 2289, PAGE 406, AND LYING 8 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE:

COMMENCING AT THE SOUTHEAST CORNER OF LOT 1; THENCE ALONG THE SOUTH LINE OF SAID LOT, N84°31’10”W, 119.59 FEET; THENCE N76°16’30”W, 53.67 FEET; THENCE N13°43’30”E, 190.28 FEET TO THE POINT OF BEGINNING; THENCE N17°22’45”E, 175.00 FEET; THENCE N13°11’00”W, 180.00 FEET; THENCE N27°26’50”W, 94.20 FEET; THENCE N7°11’25”W, 167.94 FEET TO THE END OF SAID DESCRIBED CENTERLINE.

A 16 FOOT WIDE STRIP OF LAND DESCRIBED AS LINE E AND LOCATED IN THE SOUTH HALF OF SECTION 9, TOWNSHIP 48 NORTH, RANGE 13 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, AND BEING PART OF LOT 1 OF SMITHTON RIDGE PLAT 4 AS RECORDED IN PLAT BOOK 34, PAGE 53, ALSO BEING PART OF THE SANITARY SEWER EASEMENT RECORDED IN BOOK 2289, PAGE 409, AND LYING 8 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE:

COMMENCING AT THE SOUTHEAST CORNER OF LOT 1; THENCE ALONG THE SOUTH LINE OF SAID LOT, N84°31’10”W, 119.59 FEET; THENCE N76°16’30”W, 53.67 FEET; THENCE N13°43’30”E, 190.28 FEET; THENCE N17°22’45”W, 175.00 FEET; THENCE N13°11’00”E, 180.00 FEET TO THE POINT OF BEGINNING; THENCE N68°19’30”W, 252.18 FEET TO THE END OF SAID DESCRIBED CENTERLINE.

are in excess and surplus to the needs of the City and are hereby vacated.

    SECTION 2.  The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 3.  This ordinance shall be in full force and effect from and after its passage.
