Section 106-199; Ord. 18477; Rezoning property located on the northwest corner of West Worley Street and Bernadette Drive from District C-1 to District C-P; approving the C-P development plan of Chuck E. Cheese’s Restaurant

AN ORDINANCE

rezoning property located on the northwest corner of West Worley Street and Bernadette Drive from District C-1 to District C-P; repealing all conflicting ordinances or parts of ordinances; approving the C-P development plan of Chuck E. Cheese’s Restaurant; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land located in Section 10, Township 48 North, Range 13 West in Columbia, Boone County, Missouri; being a part of Lot 1 of K-Mart Subdivision in Columbia, Missouri and more particularly described as follows:

Starting at the southwesterly corner of Lot 1, K-Mart Subdivision, being S 83E59' E 20.0 feet, North 40.0 feet, S 83E59' E 62.3 feet, N 0E01'30" W 33.3 feet from the center of Section 10, Township 48 North, Range 13 West; thence following said Lot 1, S 49E10'50" E 35.24 feet; thence S 83E59'00" E 330.82 feet to the Point of Beginning.

From the Point of Beginning N 6E08'30" E 200.00 feet; thence S 69E19'45" E 219.16 feet to the east line of Lot 1 and being a 908.27 foot radius curve to the left; thence along said curve 116.61 feet, the chord being S 12E10'30" W 116.53 feet to the PRC of a 30.00 foot radius curve to the right; thence along said curve 45.83 feet, the chord being S 52E15'20" W 41.50 feet; thence N 83E59'00" W 170.00 feet to the beginning and containing 35,152 square feet or 0.81 acres.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District C-1 (Intermediate Business District).  Hereafter the property may be used for all permitted uses in District C-1 and an arcade.  

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The City Council hereby approves the Chuck E. Cheese’s Restaurant C-P Development Plan, dated March 14, 2005, for the property referenced in Section 1 above.  The Director of Planning and Development shall use the design parameters set forth in Exhibit A, which is attached to and made a part of this ordinance, as guidance when considering any future revisions to the C-P Development Plan.

    SECTION 4.    This ordinance shall be in full force and effect from and after its passage.
