AN ORDINANCE

determining that it is in the public interest to proceed with construction of improvements to the MKT Trail access at Providence Road and Stewart Road; approving and adopting plans and specifications; determining that the work shall be done by contract; calling for bids through the Purchasing Division; providing for payment for the improvement; appropriating funds; providing for compliance with the prevailing wage law; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    Subsequent to the adoption of a resolution by the City Council, declaring the necessity for construction of improvements to the MKT Trail access at Providence Road and Stewart Road and pursuant to the publication of the resolution in a daily newspaper of general circulation in the City of Columbia, Missouri, and the affidavit of publication filed; and after a public hearing as provided for in Section 75 of the Home Rule Charter, the Council finds and determines that construction of such improvements, including the extension of the MKT Trail under Providence Road and Stewart Road, is necessary for the welfare and improvement of the city and that it is in the public interest that such improvements be made.

    SECTION 2.  The plans and specifications for these improvements filed in the office of the city clerk, are hereby approved, adopted and made a part hereof by reference as fully as if set forth herein verbatim.

    SECTION 3.    The City Manager, through the head of the purchasing division, is hereby authorized to call for bids and award a contract for the lowering and relocation of existing sewer lines.  As deemed advisable by the City Manager pursuant to Section 70 of the City Charter, city employees shall be used to construct the other improvements.

    SECTION 4. Payment for this improvement shall be made from Capital Improvement Sales Tax Funds, a Recreation Trails Program Grant, and such other funds as may be lawfully appropriated.

    SECTION 5.    The sum of $75,253.50 is hereby appropriated from the Federal Revenues Account No. 440-0000-461.10-00, C00118 and $75,253.50 is hereby appropriated from the Capital Improvement Sales Tax Account No. 440-8800-548.49-90, C40113 to the MKT Providence Road Underpass Account No. 440-8800-548.49-90, C00118.

    SECTION 6.    The City shall cause to be inserted into the contract a stipulation to the effect that not less than the prevailing hourly rate of wages, as found by the Department of Labor and Industrial Relations of Missouri, shall be paid to all workers performing work under the contract. The contractor's bond shall include such provisions as will guarantee the faithful performance of the prevailing hourly wage clause, as provided by the contract.

    SECTION 7.    This ordinance shall be in full force and effect from and after its passage.
