Section 106-214; Ord. 18488; Approving the Final Plat of Concorde Office & Industrial Plaza Plat 14, a major subdivision; authorizing a performance contract; granting a variance from the Subdivision Regulations

approving the Final Plat of Concorde Office & Industrial Plaza Plat 14, a major
accepting the dedication of rights-of-way and easements; authorizing a performance contract;
granting a variance from the Subdivision Regulations; and fixing the time when this ordinance
shall become effective.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
SECTION 1. The City Council hereby approves
the Final Plat of Concorde Office &
Industrial Plaza Plat 14, dated January 31, 2005, a major subdivision located along the north and
east sides of Maguire Boulevard, containing approximately 55.06 acres in the City of Columbia,
Boone County, Missouri, and hereby authorizes and directs the Mayor and City Clerk to sign the
plat evidencing such approval.
SECTION 2. The City Council hereby accepts
the dedication of all rights-of-way and
easements as dedicated upon the plat.
SECTION 3. The City Manager is hereby
authorized to execute a performance contract with
Robert M. Lemone and Three Guys With a Building Partnership in connection with the approval
of the Final Plat of Concorde Office & Industrial Plaza Plat 14. The form and content of the
contract shall be substantially as set forth in "Exhibit A" attached hereto and made a part
as fully as if set forth herein verbatim.
SECTION 4. Subdivider is granted a variance
from the requirements of Section 25-56 of the
Subdivision Regulations so that sanitary sewers shall not be required to be extended to the
property subject to the condition that no building permit shall be issued for any lot until a
sanitary sewer is available to that lot.
SECTION 5. This ordinance shall be in
full force and effect from and after its passage.
