Section 106-223; Ord. 18497; Authorizing the City Manager to execute a right of use permit with The Curators of the University of Missouri within Ninth Street right-of-way

AN ORDINANCE

authorizing the City Manager to execute a right of use permit with The Curators of the University of Missouri to allow construction, improvement, operation and maintenance of underground domestic water lines, chilled water pipes, control cables in conduit and an electric duct bank within Ninth Street right-of-way; setting the dates of street closures for construction; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:
    
    SECTION 1. The City Manager is hereby authorized to execute a right of use permit with The Curators of the University of Missouri to allow construction, improvement, operation and maintenance of underground domestic water lines, chilled water pipes, control cables in conduit and an electric duct bank within Ninth Street right-of-way.  The form and content of the permit shall be substantially as set forth in "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 2.  The City Council hereby authorizes The Curators of the University of Missouri to temporarily close Ninth Street from University Avenue south to Missouri Avenue from May 16, 2005 through August 15, 2005.

    SECTION 3.  The Curators of the University of Missouri shall close streets only in accordance with the traffic control plan submitted and approved by the City’s Director of Public Works.  The Curators of the University of Missouri shall be responsible for all signs and barricades necessary for the protection and convenience of the general public.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage.
