AN ORDINANCE

rezoning property located on both sides of Glenstone Drive, south of the intersection of Glenstone Drive and I-70 Drive Southeast, from District A-1 to District PUD-9; repealing all conflicting ordinances or parts of ordinances; approving the PUD site plan of Creek Pointe; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

Three tracts of land located in the Northwest Quarter of Section 9, Township 48 North, Range 12 West, in Columbia, Boone County, Missouri being a portion of the tract described by Warranty Deed in Book 1303 at Page 957 of the Boone County Records and being further described as follows:

All of Lot 103 of Creek Pointe Subdivision Plat No. 1 as recorded in Plat Book 31 at Page 41 of the Boone County Records.

And
All of Lot 104 of Creek Pointe Subdivision Plat No. 1 as recorded in Plat Book 31 at Page 41 of the Boone County Records.

And

All of Lot 105 of Creek Pointe Subdivision Plat No. 1 as recorded in Plat Book 31 at Page 41 of the Boone County Records except a portion of said Lot 105 described as follows:  Beginning at the northwest corner of said Lot 105; thence with the boundary of said Lot 105 S84°12’40”E, 12.20 feet; thence along a curve to the right having a radius of 30.00 feet for an arc distance of 44.53 feet, the long chord bears S41°41’30”E, 40.55 feet; thence S0°49’35”W, 463.25 feet; thence leaving said boundary N88°44’25”W, 43.30 feet to a point on the west boundary of said Lot 105; thence with said boundary N1°15’35”E, 493.88 feet to the point of beginning and said exception containing 0.46 acres.

The total area of the three tracts described above is 6.02 acres.

will be rezoned and become a part of District PUD-9 (Planned Unit Development) with a development density not exceeding nine dwelling units per acre and taken away from District A-1 (Agricultural District).  Hereafter the property may be used for attached two unit buildings (duplexes) and attached four unit buildings.  The statement of intent submitted by applicant, marked “Exhibit A” is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The City Council hereby approves the Creek Pointe PUD site plan, dated April, 2005, for the property referenced in Section 1 above.

    SECTION 4.    This ordinance shall be in full force and effect from and after its passage.
