AN ORDINANCE

rezoning property located west of Silvey Street and north of West Worley Street from District R-1 to District PUD-3.6; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND LOCATED IN THE NORTHWEST QUARTER OF SECTION 9, TOWNSHIP 48 NORTH, RANGE 13 WEST, BOONE COUNTY, MISSOURI, BEING SHOWN AND DESCRIBED AS TRACT 1 OF THE SURVEY RECORDED IN BOOK 1502, PAGE 530, RECORDS OF BOONE COUNTY, MISSOURI.

A PORTION OF THE TRACT OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 8, TOWNSHIP 48 NORTH, RANGE 13 WEST, BOONE COUNTY, MISSOURI, BEING DESCRIBED BY THE TRUSTEE’S DEED RECORDED IN BOOK 506, PAGE 199.

A PORTION OF THE TRACT OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 8, TOWNSHIP 48 NORTH, RANGE 13 WEST, BOONE COUNTY, MISSOURI, BEING DESCRIBED BY THE WARRANTY DEED RECORDED IN BOOK 508, PAGE 624.

will be rezoned and become a part of District PUD-3.6 (Planned Unit Development) with a development density not exceeding 3.6 dwelling units per acre and taken away from District R-1 (One-Family Dwelling District).  Hereafter the property may be used for single family attached villas with zero lot lines and all accessory uses allowed in District R-1 (Single-Family Dwelling District).  The statement of intent submitted by applicant, marked “Exhibit A” is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    Approval of this rezoning is subject to the condition that prior to any approval of any PUD Development Plan, a payment of twenty-five dollars ($25.00) per lineal foot of frontage on Silvey Street shall be made to the City for future improvements to Silvey Street.  This payment shall be returned if construction of Silvey Street has not been started within ten years of approval of the PUD Development Plan.

    SECTION 4.    This ordinance shall be in full force and effect from and after its passage.
