AN ORDINANCE

rezoning property located on the north side of Nifong Boulevard, between Santiago Drive and Bethel Street, from District R-3 to District C-P; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND IN THE SOUTH HALF OF THE SOUTHWEST QUARTER OF SECTION 25, T48N, R13W, BOONE COUNTY, MISSOURI, BEING THE SOUTH PART OF LOT 3, ROCKBRIDGE SUBDIVISION, BLOCK V, COLUMBIA, MISSOURI, SHOWN BY A SUBDIVISION PLAT RECORDED IN PLAT BOOK 11, PAGE 166, AND BEING TRACT “A” OF A SEVEN-TRACT SURVEY RECORDED IN BOOK 460, PAGE 495, BOTH OF THE BOONE COUNTY RECORDS, AND BEING DESCRIBED AS FOLLOWS:

BEGINNING AT THE NORTHWEST CORNER OF SAID TRACT “A”, BEING THE ORIGINAL ROUNDING PC OF SAID LOT 3 ALONG THE EAST RIGHT-OF-WAY OF BETHEL STREET;  THENCE N3º-59’W, ALONG THE WEST LINE OF SAID LOT 3, BEING SAID RIGHT-OF-WAY LINE, 226.00 FEET; THENCE N86º-01’E 376.70 FEET TO A LINE 219 FEET NORTH OF AND PARALLEL WITH THE LONGEST SOUTHERN LINE OF SAID TRACT “A”; THENCE N77º-42’E, ALONG SAID PARALLEL LINE, 379.75 FEET TO THE EAST LINE OF SAID LOT 3, BEING THE WEST RIGHT-OF-WAY LINE OF SANTIAGO DRIVE; THENCE S2º-57’E, ALONG LAST SAID LOT LINE AND SAID RIGHT-OF-WAY LINE, 121.88 FEET TO THE ORIGINAL ROUNDING PC OF SAID LOT ALONG THE WEST RIGHT-OF-WAY LINE OF SAID DRIVE, BEING THE NORTHEAST CORNER OF SAID TRACT “A”; THENCE, FOLLOWING THE LINES OF SAID TRACT “A” AND THE RIGHT-OF-WAY LINES OF SANTIAGO STREET, NIFONG BOULEVARD AND BETHEL STREET: S2º-57’E 74.60 FEET TO THE PC OF A CURVE HAVING A RADIUS OF 30 FEET; ALONG SAID CURVE TO THE RIGHT, 42.23 FEET ( A CHORD S37º-22’–30”W  38.83 FEET) TO THE PT OF SAID CURVE; S77º-42’W 634.50 FEET; S88º-52’W 67.00 FEET TO THE PC OF A CURVE HAVING A RADIUS OF 30 FEET; ALONG LAST SAID CURVE TO THE RIGHT, 45.63 FEET (A CHORD N47º-33’-30”W 41.36 FEET) TO THE PT OF LAST SAID CURVE; AND N3º-59’W 3.15 FEET TO THE POINT OF BEGINNING AND CONTAINING 4.024 ACRES (175,270 SQUARE FEET).

BEARINGS ARE BASED ON THE SUBDIVISION PLAT OF ROCKBRIDGE SUBDIVISION, BLOCK V, COLUMBIA, MISSOURI AS SHOWN IN PLAT BOOK 11, PAGE 166, AND ON THE SEVEN-TRACT SURVEY RECORDED IN BOOK 460, PAGE 495, BOTH OF THE BOONE COUNTY RECORDS.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District R-3 (Medium Density Multiple Family Dwelling District).  Hereafter the western one-half of the property may be used for a bank and the eastern one-half of the property may be used for all permitted uses in District C-1 except for the following: alcoholic beverage sales, adult entertainment retail sales, convenience store, freestanding fast food restaurants with drive-thru facilities and tattoo parlors.  The statement of intent, marked “Exhibit A,” is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    This ordinance shall be in full force and effect from and after its passage.
