A RESOLUTION

declaring the necessity for construction of sidewalks along portions of Bluff Creek Drive, Scarlet Oak Court, Catalpa Court, Snowberry Circle, Coventry Court, Yorkshire Drive, Campusview Drive, UMC Drive, Norman Drive, Hal Court and Medford Drive; stating the nature of and the estimate of the cost thereof; providing for payment for the improvement; providing for compliance with the prevailing wage law; and setting a public hearing.

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council deems the construction of sidewalks, together with miscellaneous work, all in accordance with the City of Columbia Street and Storm Sewer Specifications and Standards, along Bluff Creek Drive, Scarlet Oak Court, Catalpa Court, Snowberry Circle, Coventry Court, Yorkshire Drive, Campusview Drive, UMC Drive, Norman Drive, Hal Court and Medford Drive; necessary to the welfare and improvement of the City.

    SECTION 2.    The nature and scope of the improvement shall consist of furnishing all labor, materials, transportation, insurance and all other items, accessories and incidentals thereto necessary for the complete construction of the improvements.

    SECTION 3.    The estimated cost of this improvement is $103,160.00.

    SECTION 4.    Payment for the improvement along Bluff Creek Drive shall be made by special tax bills evidencing special assessments levied and assessed against the property specially benefitted by and abutting the improvement in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in an amount not to exceed $6.60 per square foot, and the balance from capital improvement sales tax funds, transportation sales tax funds and such other funds as may be lawfully appropriated.  

    SECTION 5.    Payment for the improvement along Scarlet Oak Court shall be made by special tax bills evidencing special assessments levied and assessed against the property specially benefitted by and abutting the improvement in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in an amount not to exceed $10.30 per square foot, and the balance from capital improvement sales tax funds, transportation sales tax funds and such other funds as may be lawfully appropriated.
    SECTION 6.    Payment for the improvement along Catalpa Court shall be made by special tax bills evidencing special assessments levied and assessed against the property specially benefitted by and abutting the improvement in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in an amount not to exceed $10.87 per square foot, and the balance from capital improvement sales tax funds, transportation sales tax funds and such other funds as may be lawfully appropriated.    

    SECTION 7.    Payment for the improvement along Snowberry Circle shall be made by special tax bills evidencing special assessments levied and assessed against the property specially benefitted by and abutting the improvement in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in an amount not to exceed $6.89 per square foot, and the balance from capital improvement sales tax funds, transportation sales tax funds and such other funds as may be lawfully appropriated.

    SECTION 8.    Payment for the improvement along Coventry Court shall be made by special tax bills evidencing special assessments levied and assessed against the property specially benefitted by and abutting the improvement in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in an amount not to exceed $8.53 per square foot, and the balance from capital improvement sales tax funds, transportation sales tax funds and such other funds as may be lawfully appropriated.

    SECTION 9.    Payment for the improvement along Yorkshire Drive shall be made by special tax bills evidencing special assessments levied and assessed against the property specially benefitted by and abutting the improvement in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in an amount not to exceed $6.70 per square foot, and the balance from capital improvement sales tax funds, transportation sales tax funds and such other funds as may be lawfully appropriated.
    
    SECTION 10.    Payment for the improvement along Campus View Drive and UMC Drive shall be made from capital improvement sales tax funds, transportation sales tax funds and such other funds as may be lawfully appropriated.

    SECTION 11.    Payment for the improvement along Norman Drive shall be made by special tax bills evidencing special assessments levied and assessed against the property specially benefitted by and abutting the improvement in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in an amount not to exceed $6.95 per square foot, and the balance from capital improvement sales tax funds, transportation sales tax funds and such other funds as may be lawfully appropriated.

    SECTION 12.    Payment for the improvement along Hal Court shall be made by special tax bills evidencing special assessments levied and assessed against the property specially benefitted by and abutting the improvement in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in an amount not to exceed $16.36 per square foot, and the balance from capital improvement sales tax funds, transportation sales tax funds and such other funds as may be lawfully appropriated.
    SECTION 13.    Payment for the improvement along Medford Drive shall be made by special tax bills evidencing special assessments levied and assessed against the property specially benefitted by and abutting the improvement in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in an amount not to exceed $20.54 per square foot, and the balance from capital improvement sales tax funds, transportation sales tax funds and such other funds as may be lawfully appropriated.

    SECTION 14.    Any work done in connection with the construction of the improvement specified above shall be in compliance with the provisions of the prevailing wage laws of the Department of Labor and the State of Missouri, such prevailing wage rates having been established by the Department of Labor and Industrial Relations of Missouri.

    SECTION 15.    This resolution shall be published in a daily newspaper of general circulation in the City of Columbia for seven (7) consecutive insertions, and a public hearing in respect to this improvement will be held in the Council Chamber of the Daniel Boone Building, 701 E. Broadway, Columbia, Missouri, at 7:00 p.m. on September 19, 2005.
