AN ORDINANCE

rezoning property located on the northwest side of Hanover Boulevard, across from Hidden Creek Court from District PUD-4 to District PUD-7.2; repealing all conflicting ordinances or parts of ordinances; setting forth conditions of approval; approving the PUD development plan of Hidden Creek Condominiums; approving a building height modification; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND LOCATED IN THE NORTH HALF AND IN THE SOUTHWEST QUARTER OF SECTION 4, TOWNSHIP 48 NORTH, RANGE 12 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, BEING PART OF THE TRACTS DESCRIBED BY THE WARRANTY DEEDS RECORDED IN BOOK 585, PAGE 565, BOOK 1559, PAGE 644 AND BOOK 1728, PAGE 304 AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

will be rezoned and become a part of District PUD-7.2 (Planned Unit Development) with a development density not exceeding 7.2 dwelling units per acre and taken away from District PUD-4 (Planned Unit Development not exceeding 4 dwelling units per acre).  Hereafter the property may be used for all permitted uses in District R-3 (Medium Density Multiple-Family Dwelling District).  The statement of intent submitted by applicant, marked “Exhibit A” is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The rezoning of the property described in Section 1 shall be subject to the following conditions:
    1.    No more than 170 dwelling units shall be approved for construction until Mexico Gravel Road is connected to Vandiver Drive, extended, east of Hinkson Creek.

    2.    No more than 227 dwelling units shall be approved for construction until the following items are completed by the developer:

a.    Left turn lanes shall be added to State Route PP at the Hanover Boulevard and Olympic Boulevard intersections; and

b.    The Riney Lane street extension between Hanover Boulevard and the proposed eastward extension of Vandiver Drive be completed (with a grade not exceeding 10%) and accepted by the City.

    3.    The size and location of the monument sign shall comply with R-3 Zoning District regulations.

    4.    A greenspace trail easement shall be shown along Hinkson Creek on any subsequent final plats which include the Hinkson Creek flood plain.

    SECTION 4.    The City Council hereby approves the PUD Development Plan of Hidden Creek Condominiums dated August 8, 2005, for the property referenced in Section 1 above.

    SECTION 5.    The City Council approves a maximum building height of forty-nine (49) feet.

    SECTION 6.    This ordinance shall be in full force and effect from and after its passage.
