Section 106-660; Ord. 18756; Rezoning property located on the north side of Mexico Gravel Road, adjacent to the east side of U.S. Highway 63 from District A-1 to District C-P

rezoning property located on the north side of Mexico Gravel Road, adjacent to the east side of U.S. Highway 63 from District A-1 to District C-P; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.


    SECTION 1.    The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land in the SW ¼ of Section 33 T49N, R12W in Boone County, Missouri being more particularly described as follows:

Starting at the NE corner of Hill Haven Estates as recorded in Plat Book 10, Page 3 of the Boone County Records, said corner also being the NW corner of the SW ¼  of Section 33, T49N, R12W; thence along the north line of said SW ¼, N88º22’E, 488.39 feet to the intersection of said north line of the SW ¼ and the east right-of-way of Highway 63, said point being the POINT OF BEGINNING; thence continuing along said north line of the SW ¼, N88º22’E, 197.17 feet to the NW corner of a survey shown in Book 289, Page 469; thence along the west line of said survey, S37º52’E, 593.00 feet to the SW corner of said survey and the center of Hinkson Creek; thence along the center of said creek, S23º36’E, 160.26 feet; thence S41º27’E, 217.13 feet; thence S16º41’E, 271.13 feet to the north right-of-way of Mexico Gravel Road; thence along said right-of-way S70º35’W, 53.19 feet; thence on a curve to the left, 249.70 feet, the chord of said curve being S34º48’W, 233.79 feet; thence S14º10’W, 114.89 feet; thence S39º10’W, 65.46 feet to the north line of a survey shown in Book 289, Page 179; thence along said north line N81º05’W, 148.05 feet to the east right-of-way of Highway 63, thence along said right-of-way N14º50’W, 206.37 feet; thence N3º57’W, 265.73; thence N10º54’W, 322.25 feet; thence N27º45’W, 677.67 feet to the POINT OF BEGINNING and containing 10.038 acres.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District A-1 (Agricultural District).  Hereafter the property may be used for the following uses: commercial garden center, nursery, and outdoor/open air sale of bulk gardening/landscaping materials.  The statement of intent, marked “Exhibit A,” is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The rezoning of the property described in Section 1 shall be subject to the following conditions:

1.    A traffic study shall be completed as part of the C-P Development Plan.  The developer shall be responsible for any needed off-site improvements identified in the traffic study.

2.    No driveway access shall be allowed from the subject tract onto Mexico Gravel Road.  All access to the site must be off of Hinkson Creek Road.

    SECTION 4.    This ordinance shall be in full force and effect from and after its passage.
