AN ORDINANCE

rezoning property located on the northeast corner of West Broadway (State Route TT) and Stadium Boulevard (State Route 740) from Districts R-3 and C-P to District O-P; repealing all conflicting ordinances or parts of ordinances; setting forth conditions of approval; approving the O-P development plan of Shelter Office Plaza; approving less stringent screening requirements; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land located in the southeast quarter of Section 10 T48N R13W, in Columbia, Boone County, Missouri, being Lot 1 Burger King Subdivision, recorded in plat book 34 page 83, and part of Lot 1 Shelter Insurance Subdivision, recorded in plat book 32 page 27.

Beginning at the northwest corner of Lot 1 Burger King Subdivision, thence S85°47’00”E, along the northerly line thereof, 156.76 feet to a corner of Lot 1 Shelter Insurance Subdivision; thence continuing S 85°47’00”E, along the line of Lot 1 Shelter Insurance Subdivision, 425.67 feet to a corner of said Lot 1; thence, leaving the line of Lot 1 Shelter Insurance Subdivision, S 0°15’20”E 421.25 feet to the southerly line of said Lot 1; thence along said line, N 83°31’50”W 288.92 feet; thence N 78°15’50”W 108.96 feet; thence N 83°31’50”W 30.07 feet to the southeast corner of Lot 1 Burger King Subdivision; thence along the lines of said Lot 1, N 83°31’50”W 113.60 feet; thence N 14°40’00”W 176.20 feet; thence N 0°24’40”W 222.71 feet to the beginning and containing 5.32 acres.

will be rezoned and become a part of District O-P (Planned Office District) and taken away from District R-3 (Medium Density Multiple-Family Dwelling District) and District C-P (Planned Business District). Hereafter the property may be used for the following uses:

    Banks, other financial institutions and travel agencies.

Buildings and premises for public utility services or public service corporations.

Counseling centers operated by charitable or not-for-profit organizations, excluding halfway houses or any use connected with penal or correctional institutions.

    Drive-up facilities incidental to any permitted uses.

Office buildings used for the administrative functions of businesses, professions, companies, corporations, and social, philanthropic, eleemosynary, or governmental organizations or societies.

Offices for professional and business use involving the sale or provision of services, but not the sale or rental of goods, including but not limited to:
(1)    Artists, sculptors, photographers.
(2)    Authors, writers, composers.
(3)    Lawyers, engineers, planners, architects, Realtors, accountants, insurance agents, brokers, and other consultants in similar professions.
(4)    Ministers, rabbis, priests, or other clergy members.
(5)    Physicians, dentists, chiropractors, or other licensed medical practitioners.
(6)    Seamstresses, tailors.
(7)    Teachers of private lessons in art, music, or dance.

Research and development laboratories, provided there is minimal/insignificant use of hazardous materials based on a risk assessment.

Schools operated as a business within an enclosed building, except trade schools and schools which offer retail goods or services to the public.  

The statement of intent, marked “Exhibit A,” is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The rezoning of the property described in Section 1 shall be subject to the condition that a left turn lane for eastbound traffic on West Broadway (State Route TT) shall be constructed prior to issuance of any occupancy permits.

    SECTION 4.    The City Council hereby approves the Shelter Office Plaza O-P Development Plan, dated October 27, 2005, for the property referenced in Section 1 above.  The Director of Planning and Development shall use the design parameters set forth in Exhibit B, which is attached to and made a part of this ordinance, as guidance when considering any future revisions to the O-P Development Plan.

    SECTION 5.    The City Council approves less stringent screening requirements than those set forth in Section 29-13.1(d)(6) of the Zoning Regulations so that landscaping shall not be required along the north side of the screening fence to be installed along the north property line.

    SECTION 6.    This ordinance shall be in full force and effect from and after its passage.
