AN ORDINANCE
rezoning property located on the southeast corner of the intersection of State Route K and RA Nursery Road from District R-1 to District C-P; repealing all conflicting ordinances or parts of ordinances; setting forth conditions of approval; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 29-4 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

The tract of land to be rezoned is described as Lot 72 of Boone’s Pointe subdivision, located in the North half of the Southwest quarter of Section 9, Township 47 North, Range 13 west, and containing approximately 3.15 Acres.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District R-1 (One-Family Dwelling District).  Hereafter the property may be used for the following uses:

    Service stations and convenience stores
    Neighborhood grocery stores
    Neighborhood butcher shops
    Bicycle repair
Restaurants and cafes (with the service of alcoholic beverages only in conjunction with food service; fast food restaurants with drive-thru windows are excluded)
    Branch bank or ATM
    Office
    Day care center
    Car wash
    Beauty or barber shops.  

The statement of intent, marked “Exhibit A,” is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The rezoning of the property described in Section 1 shall be subject to the following condition:

1.    A C-P development plan shall not be approved until the following roadway improvements are complete:

(a)    RA Nursery Road shall be paved to meet Public Works Department standards for a “dust-free” surface; and

(b)    Sight distance improvements and dedicated left turn lanes shall be constructed at the intersection of Scott’s Boulevard and State Route K.

    SECTION 4.    This ordinance shall be in full force and effect from and after its passage.
