rezoning property located on the north side of Mexico Gravel Road, along both sides
Wellington Drive from District R-1 to District PUD-2.5; repealing all conflicting ordinances or
parts of ordinances; and fixing the time when this ordinance shall become effective.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
SECTION 1. The Zoning District Map established
and adopted by Section 29-4 of the Code
of Ordinances of the City of Columbia, Missouri, is amended so that the following property:
THREE TRACTS OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 33,
TOWNSHIP 49 NORTH, RANGE 12 WEST, COLUMBIA, BOONE COUNTY, MISSOURI,
BEING THE LAND DESCRIBED BY THE WARRANTY DEED RECORDED IN BOOK 797,
PAGE 435 AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHWEST CORNER OF LOT 18 OF WELLINGTON ESTATES
PLAT 4 RECORDED IN PLAT BOOK 32, PAGE 16; THENCE WITH THE WEST LINE OF
SAID LOT, S0°32'50"E, 576.41 FEET TO THE NORTH LINE OF THE SURVEY RECORDED
IN BOOK 333, PAGE 86 OF THE BOONE COUNTY RECORDS; THENCE LEAVING SAID
WEST LINE AND WITH SAID NORTH LINE S88°44'30"W, 320.04 FEET TO THE EAST
LINE OF A 30 ROADWAY EASEMENT RECORDED IN BOOK 171, PAGE 125 OF THE
BOONE COUNTY RECORDS; THENCE LEAVING SAID NORTH LINE AND WITH SAID
EAST LINE N01°47'35"E, 580.11 FEET TO THE QUARTER QUARTER SECTION LINE;
THENCE LEAVING SAID EAST LINE WITH SAID QUARTER QUARTER SECTION LINE
N89°18'25"E, 296.32 FEET TO THE POINT OF BEGINNING AND CONTAINING 4.09
BEGINNING AT THE SOUTHWEST CORNER OF LOT 18 OF WELLINGTON ESTATES
PLAT 4; THENCE WITH THE SOUTH LINE OF SAID PLAT 4, N89°40'45"E, 711.90 FEET
TO THE WEST LINE OF LOT B OF THE SURVEY RECORDED IN BOOK 310, PAGE 70
OF THE BOONE COUNTY RECORDS; THENCE LEAVING SAID SOUTH LINE, WITH
SAID WEST LINE S00°17'00"W, 210.00 FEET TO THE NORTH RIGHT-OF-WAY LINE OF
MEXICO GRAVEL ROAD; THENCE LEAVING SAID WEST LINE AND WITH SAID
NORTH RIGHT-OF-WAY LINE N89°31'25"W, 717.10 FEET TO THE EAST LINE OF
TRACT 3 AS SHOWN ON THE SURVEY RECORDED IN BOOK 270, PAGE 300; THENCE
LEAVING SAID NORTH RIGHT-OF-WAY LINE, WITH SAID EAST LINE N01°47'35"E,
200.15 FEET TO THE POINT OF BEGINNING AND CONTAINING; EXCEPT THAT
PORTION OF THE ABOVE DESCRIBED TRACT FALLING WITHIN WELLINGTON
DRIVE RIGHT-OF-WAY AND CONTAINING 3.12 ACRES.
LOT 18 OF WELLINGTON ESTATES PLAT 4 AS SHOWN BY WELLINGTON ESTATES
PLAT 4 RECORDED IN PLAT BOOK 32, PAGE 16 AND CONTAINING 15.96 ACRES.
will be rezoned and become a part of District PUD-2.5 (Planned Unit Development) with
development density not exceeding 2.5 dwelling units per acre and taken away from District R-1
(One-Family Dwelling District). Hereafter the property may be used for single family attached
villas with zero lot lines and all accessory uses allowed in District R-1 (One-Family Dwelling
District). The statement of intent submitted by applicant, marked Exhibit A is attached
made a part of this ordinance.
SECTION 2. All ordinances or parts of
ordinances in conflict with the provisions of this
ordinance are hereby repealed.
SECTION 3. This ordinance shall be in
full force and effect from and after its passage.
