     AN ORDINANCE

approving the Final Plat of Grindstone Plaza Subdivision, a major subdivision; accepting the dedication of rightsofway and easements; authorizing a performance contract; authorizing a development agreement; accepting conveyances; directing the City Clerk to have the conveyances recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

SECTION 1.    The City Council hereby approves the Final Plat of  Grindstone Plaza Subdivision, dated September 12, 2005, a major subdivision located on the north side of Grindstone Parkway (State Route AC), between Green Meadows Road and Rock Quarry Road, containing approximately 58.70 acres in the City of Columbia, Boone County, Missouri, and hereby authorizes and directs the Mayor and City Clerk to sign the plat evidencing such approval.

SECTION 2.    The City Council hereby accepts the dedication of all rightsofway and easements as dedicated upon the plat.

SECTION 3.    The City Manager is hereby authorized to execute a performance contract with THF Grindstone Plaza Development, L.L.C. and Grindstone Plaza Transportation Development District in connection with the approval of the Final Plat of Grindstone Plaza Subdivision.  The form and content of the contract shall be substantially as set forth in "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

SECTION 4.    The City Manager is hereby authorized to execute a development agreement with THF Grindstone Plaza Development,  L.L.C. and Grindstone Plaza Transportation Development District in connection with the approval of the Final Plat of Grindstone Plaza Subdivision.  The form and content of the agreement shall be substantially as set forth in "Exhibit B" attached hereto and made a part hereof as fully as if set forth herein verbatim.

SECTION 5.    The City of Columbia accepts the Grant of Easement for Street Purposes, a copy of which, marked "Exhibit C" is attached to this ordinance.  The City accepts the Conservation (Park) Easement, a copy of which, marked "Exhibit D" is attached to this ordinance.

SECTION 6.    The City Clerk is authorized and directed to have the Grant of Easement for Street Purposes and the Conservation (Park) Easement recorded in the office of the Boone County Recorder of Deeds.

SECTION 7.    An amendment to the landscape master plan, a part of the approved C-P development plan showing changes to the park area at the intersection of Grindstone Parkway and Rock Quarry Road to conform with the provisions of the development agreement shall be considered a minor revision to the C-P development plan.

SECTION 8.    This ordinance shall be in full force and effect from and after its passage.
