    AN ORDINANCE

rezoning property located on the east side of Rock Quarry Road, south of Grindstone Parkway from District A-1 to District PUD-6.1; setting forth conditions of approval; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

SECTION 1.    The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land containing 6.06 acres, more or less, located in the West Half (W 2) of the Southeast Quarter (SE 3) of Section Thirty (30), Township Forty-Eight (48) North, Range Twelve (12) West, of the Fifth (5th) Principal Meridian, in the City of Columbia, Boone County, Missouri, as shown and described by the Survey thereof recorded on June 14, 1979 as Document Number 7080 in Book 465, Page 315, Deed Records of Boone County, Missouri.

will be rezoned and become a part of District PUD-6.1 (Planned Unit Development) with a development density not exceeding 6.1 dwelling units per acre and taken away from District A-1 (Agricultural District).  Hereafter the property may be used for two-family attached structures with two vehicle garages per unit.  The statement of intent submitted by applicant, marked AExhibit A@ is attached to and made a part of this ordinance.

SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION 3.    The rezoning of the property described in Section 1 shall be subject to the following conditions:

1.    A fee for future construction of Rock Quarry Road of $25.00 per lineal foot of frontage, or approximately $13,000.00, shall be made at the time of final plat review.

2.    Any future PUD development plan shall have a pedestrian access easement between the subject site and Rock Quarry Park.

SECTION 4.    This ordinance shall be in full force and effect from and after its passage.
