     AN ORDINANCE

determining that it is in the public interest to proceed with improvements to Flat Branch Park Phase II; approving and adopting plans and specifications; calling for bids through the Purchasing Division; determining that a portion of the work shall be done by City employees; providing for payment for the improvement; providing for compliance with the prevailing wage law; appropriating funds; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Council finds that the construction of improvements to Flat Branch Park Phase II, including the restoration of Flat Branch Creek to the standards established at Flat Branch Park Phase I; construction of all hardscape features including walkways, sitting areas and a new parking lot; the installation of benches, café tables, lighting and landscaping; the construction of an interactive water plaza; the routing of the MKT Trail under Locust and Elm Streets; the installation of two art sculptures; and the construction of a bridge by Allstate Consultants connecting the park to the Walton Building property, is necessary for the welfare and improvement of the City and that it is in the public interest such improvement be made.

    SECTION 2.    The plans and specifications for the improvements as prepared by the Department of Parks and Recreation and filed in the office of the City Clerk, are hereby approved, adopted and made a part hereof by reference as fully as if set forth herein verbatim.

    SECTION 3.    The construction of the stream restoration, parking lot, concrete walkways and site grading shall be done by contract in accordance with the plans and specifications adopted therefor, the laws of the State of Missouri, and the Charter and Ordinances of the City of Columbia, Missouri.  

    SECTION 4.    The City Manager, through the head of the purchasing division, is hereby authorized to call for bids and award contracts for construction of the stream restoration, parking lot, concrete walkways and site grading.  Allstate Consultants shall construct a bridge connecting the park to the Walton Building property.  As deemed advisable by the City Manager, City employees shall be used to construct the other improvements.  

    SECTION 5.    Payment for this improvement shall be made from a Land and Water Conservation Fund grant, Park Sales Tax Funds, private donations, and such other funds as may be lawfully appropriated.

    SECTION 6.    The City shall cause to be inserted into the contract a stipulation to the effect that not less than the prevailing hourly rate of wages, as found by the Department of Labor and Industrial Relations of Missouri, shall be paid to all workers performing work under the contract. The contractor's bond shall include such provisions as will guarantee the faithful performance of the prevailing hourly wage clause, as provided by the contract.

    SECTION 7.    The sum of $53,913.00 is hereby appropriated from the Donations Account No. 753-8500-480.53-15 to the Flat Branch Park Phase II Development Account No. 440-8800-548.49-90 C00133.

    SECTION 8.    This ordinance shall be in full force and effect from and after its passage.
