     AN ORDINANCE

declaring the need to acquire easements necessary to construct a 161 Kv transmission line from the intersection of Rolling Hills Road and Sugar Grove Road to the Grindstone Substation located on Grindstone Parkway; authorizing acquisition by negotiation or, if necessary, by condemnation; authorizing the City Manager to obtain and execute all instruments necessary for acquisition of such land; and fixing the time when this ordinance shall become effective.

WHEREAS, the Constitution and Statutes of the State of Missouri and the Home Rule Charter for the City of Columbia, Missouri, authorize the City Council to exercise the power of eminent domain, within or without the City, and among other things, to acquire, and maintain any property, real or personal within or without the City for all public uses or purposes, and to acquire, receive and hold any estate or interest in any such property; and

WHEREAS, the Council deems it necessary for the welfare and improvement of the City and in the public interest that certain private property be acquired by negotiation or by condemnation for public improvement.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

SECTION 1.    The City Council hereby declares the need to acquire easements necessary to construct a 161 Kv transmission line from the intersection of Rolling Hills Road and Sugar Grove Road to the Grindstone Substation located on Grindstone Parkway described as follows:

RAUL J. WALTERS, REVOCABLE LVING TRUST
PERMANENT EASEMENT

A 30 foot strip of land located in the southwest quarter of Section 29,  T48N, R12W, in Boone County, Missouri, being part of Lot 1 of the Chalet Subdivision as recorded in Book 11, Page 64 of Boone County, Records, and located southerly  and adjacent to the following described line.

Beginning at the northwest corner of Lot 1 of Chalet Subdivision, thence, along the lines of said lot, N 86E24=E 175.00 feet; thence S 47E05=E 85.06 feet to the end of the line.


RAUL J. WALTERS, REVOCABLE LIVING TRUST
PERMANENT EASEMENT

A strip of land located in the southwest quarter of Section 29, T48N, R12W, in Boone County, Missouri, being part of Lot 11 of the Chalet Subdivision as recorded in Book 11, Page 64 of Boone County, Missouri records, more particularly described as follows;

an additional ten (10) feet south of and contiguous with an existing twenty (20) foot platted easement along the north side of said lot 11, for a total of thirty (30) feet.

A strip of land located in the southwest quarter of Section 29, T48N, R12W, in Boone County, Missouri, being part of Lot I of Plat 2 in the Chalet Subdivision as recorded in Plat Book 30, Page 58 of Boone County, Missouri records, more particularly described as follows;

an additional ten (10) feet south of and contiguous with an existing twenty (20) foot platted easement along the north side of said lot 1, for a total of thirty (30) feet.

EASEMENT STRIP 1
A 30.0 foot wide strip of land, 1050.7 feet long, as follows:

Beginning at an iron at the southeast corner of Lot 2 of Lenoir Subdivision, thence with the south property line of said Lot 2, S 89°23=W  1050.7 feet to a point on the south line of Lot 2, (hereinafter referred to as Point A) the End of the Easement; said easement limited to 30.0 feet north (to the right of) the above described line.

An irregularly shaped piece of land, as follows:

A 30.0 foot wide strip of land, 1129.6 feet long, adjoining the east right of way line of US Highway 63 South and lying to the right (easterly) of the following described line:  

Beginning at the southwest corner of Lot 2 at Point >B= as described above; thence N 43°31=W  77.2 feet to the P.C. of a 1° 11.39= curve to the right; thence along said curve 416.73 feet to the P.C.C. thereof, the chord being N 36° 21=W 416.6 feet; thence along a 2° 09.34= curve to the right, 441.10 feet, the chord being N 29° 17=W 440.6 feet; thence continuing along said 2° 09.34= curve to the right, 141.32 feet to the P.T. thereof, the chord being N 22° 51=W 141.3 feet; thence N 6° 57= E 53.9 feet to the End of the Easement, said easement limited to 30.0 feet to the right of the above described line.

EASEMENT STRIP 1
A 60.0 (sixty) foot wide strip of land, approximately 7985 feet long, more or less, located in the southwest quarter of Section 27 T48N R12W and in the south half of Section 28 T48N R12W in Columbia, Boone County, Missouri, being the south 60.0 (sixty) feet of the southwest quarter of Section 27 T48N R12W and of the south half of Section 28 T48N R12W.

EASEMENT STRIP 2
A 40.0 (forty) foot wide strip of land, 650.0 feet long, located in the northwest quarter of Section 34 T48N R12W in Columbia, Boone County, Missouri, the centerline described as follows:

Starting at the northeast corner of the northwest quarter of Section 34 T48N R12W, thence S 89°09=W, along the north line of Section 34, a distance of 266.0 feet to the Point of Beginning

From the point of beginning, thence S 1°59=W 650.0 feet to the end of the centerline, said easement limited to 20.0 feet to either side of the above described centerline.

SECTION 2.    The City Manager is authorized to acquire the land described in Section 1 by negotiation.

SECTION 3.    The City Manager is authorized to obtain, execute and record all deeds and other instruments necessary to acquire the land described in Section 1.

SECTION 4.    If the City cannot agree with the owners, or those claiming an interest in the land described in Section 1, on the proper compensation to be paid for such land, or if the owner is incapable of contracting, is unknown, or cannot be found, or is a nonresident of the State of Missouri, the City Counselor is authorized to petition the Circuit Court of Boone County, Missouri, to acquire the land described in Section 1 by condemnation.

SECTION 5.    This ordinance shall be in full force and effect from and after its passage.
