Section 107-212; Ord. 18969; Approving the Final Plat of Stephens College Plat 1, a minor subdivision; authorizing a performance contract

     AN ORDINANCE

approving the Final Plat of Stephens College Plat 1, a minor subdivision; accepting the dedication of rightsofway and easements; authorizing a performance contract; granting variances from the Subdivision Regulations; setting forth a condition of approval; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council hereby approves the Final Plat of Stephens College Plat 1, dated January 19, 2006, a minor subdivision located on the southwest corner of East Broadway and South College Avenue (State Route 763), containing approximately 6.97 acres in the City of Columbia, Boone County, Missouri, and hereby authorizes and directs the Mayor and City Clerk to sign the plat evidencing such approval.

    SECTION 2.    The City Council hereby accepts the dedication of all rightsofway and easements as dedicated upon the plat.

    SECTION 3.    The City Manager is hereby authorized to execute a performance contract with Stephens College in connection with the approval of the Final Plat of Stephens College Plat 1.  The form and content of the contract shall be substantially as set forth in "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 4.    Subdivider is granted a variance from the requirements of Sections 25-35 (4) and 25-56 of the Subdivision Regulations so that sanitary sewers shall not be required to be extended to all platted lots.

    SECTION 5.    Subdivider is granted a variance from the requirements of Section 25-43 (1) of the Subdivision Regulations so that dedication of an additional one-half width rights-of-way shall not be required along the Locust Street, Waugh Street, East Broadway and South College Avenue frontages.

    SECTION 6.    Subdivider is granted a variance from the requirements of Section 25-46 (b) of the Subdivision Regulations so that a 30 foot radius truncation shall not be required on the southeast corner at the intersection of Waugh Street and East Broadway and on the northeast corner at the intersection of Waugh Street and Locust Street.  

    SECTION 7.    Subdivider is granted a variance from the requirements of Section 25-48.1 of the Subdivision Regulations so that a sidewalk shall not be required along the Locust Street and Waugh Street frontages.

    SECTION 8.    Approval of the variances in Sections 4, 5, 6 and 7 is subject to the condition that Stephens College executes and records the declaration of self-imposed restrictive covenants as set forth in "Exhibit B" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 9.    This ordinance shall be in full force and effect from and after its passage.
