     AN ORDINANCE

rezoning property located on the east side of Fay Street, approximately 400 feet south of Business Loop 70 East from District O-1 to District C-P; repealing all conflicting ordinances or parts of ordinances; approving an exception to the standards and criteria requirements for C-P developments; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

LOT FOUR (4), EXCEPT THE NORTH TWENTY-SIX (26) FEET OF THE WEST ONE HUNDRED FIVE (105) FEET THEREOF, AND ALL OF LOT FIVE (5) IN BLOCK ONE (1) OF TANDY’ S ADDITION TO THE CITY OF COLUMBIA, BOONE COUNTY, MISSOURI, AS SHOWN BY THE PLAT RECORDED IN BOOK 91, PAGE 387, RECORDS OF BOONE COUNTY, MISSOURI.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District O-1 (Office District).  Hereafter the property may be used for all permitted uses in District O-1 and a testing laboratory.  The statement of intent, marked AExhibit A,@ is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The City Council approves an exception to Section 29-17(d) of the Zoning Regulations so that the standards and criteria requirements for C-P developments are not required to be met.

    SECTION 4.    This ordinance shall be in full force and effect from and after its passage.
