     AN ORDINANCE

amending the boundaries of the Columbia Special Business District; repealing all ordinances or parts of ordinances in conflict therewith; and fixing the time when this ordinance shall become effective.

    WHEREAS, the owners of property adjacent to the Columbia Special Business District have petitioned the City Council to expand the boundaries of the District to include their properties; and

    WHEREAS, the City Council adopted Resolution No. 90-06 on April 17, 2006 declaring the intention of the City Council to amend the boundaries and enlarge the area of the Columbia Special Business District; and

    WHEREAS, a public hearing on this issue has been held on May 15, 2006.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council hereby amends and enlarges the boundaries of the Columbia Special Business District as shown on Exhibit “A” which is attached to and made a part of this ordinance.  The boundaries of the Columbia Special Business District are amended to read as follows:

BEGINNING in the center of Ash Street at a point 33 feet North of the northwest Corner of Old Town Lot 307; thence East to the center of the intersection of Seventh Street; thence North to the center of Park Avenue; thence East to the center of Ninth Street; thence South a distance of 183 feet to the center of an East-West alley (extended), thence East along the center of said alley to the east right-of-way line of Tenth Street; thence South along said east right-of-way line of Tenth Street to the north right-of-way line of Ash Street; thence East along said north right-of-way line of Ash Street to the east line of the Original Town of Columbia at the southeast corner of Lot 351 of said Original Town; thence South, 216 feet along the east line of said Original Town to the centerline of an East-West alley; thence East, along the center of said alley, to the center of Orr Street; thence North, along said center of Orr Street, to the centerline of East Ash Street;  thence East, along said centerline to the east line of Lot Six (6) (prolonged North) of Rice and Quarles Subdivision as recorded in Book 94 at page 631;  thence South along said east line and the east line of Lot Five (5) of said subdivision to a point 6.0 feet North of the southeast corner of said Lot 5;  thence East 10.0 feet to the northeast corner of Lot 4 of said subdivision;  thence South along the east line of said subdivision to the centerline of Walnut Street; thence East along said centerline to a point 33 feet North of the northeast corner of Lot 5 of Hickman's Addition as recorded in Book 37 at page 521; thence southerly along the east line of said lot and the extension thereof to the center of Broadway; thence westerly, with said center to a point due North of the northwest corner of Baptist Church Addition as recorded in Book 73 at page 26; thence South along the west line of said addition to a point due East of the northwest corner of Lot 1 of Samuel's Addition as recorded in Book 45 at page 339; thence West to the center of Hitt Street; thence South with said center of Hitt Street to the center of an East-West alley (extended), at a point 7.5 feet South of the south line of Old Town Lot 34; .thence West along the center of said alley to the east line of the west half (1/2) of Lot 32 (extended); thence South, 102.5 feet along said east line of the west half (1/2) of said Lot 32 to the north line of the south third (1/3) of said Lot 32; thence West 120.0 feet along said north line of the south third (1/3) of Lots 32 and 31 to the east right-of-way line of Tenth Street; thence South along said east right-of-way line of Tenth Street to the centerline of Elm Street; thence westerly, along said centerline of Elm Street, to the centerline of Watson Place;  thence South along said centerline of Watson Place to a point perpendicular from the southeast corner of Lot One (1) of Watson Place, Plat 2 as recorded in Plat Book 32 at page 13;  thence N.89°24’ 30”W., 15.00 feet to the southeast corner of said lot;  thence S.89°21’ 30”W., 205.83 feet to the southwest corner of said lot;  thence West to the centerline of South Ninth Street;  thence North along said centerline to the centerline of Elm Street;  thence westerly along said centerline of Elm Street to the centerline of Providence Road, also known as Missouri State Route 163; thence northerly along said Providence Road centerline to the centerline of Ash Street; thence easterly along said Ash street centerline to the POINT OF BEGINNING.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    This ordinance shall be in full force and effect from and after its passage.
