     AN ORDINANCE

rezoning property located near the southeast corner of Forum Boulevard and Forum Katy Parkway from District R-3 PUD to District C-P; repealing all conflicting ordinances or parts of ordinances; approving the Lot 3 Katy Place Heights Subdivision Plat 2 C-P Development Plan; approving a revision to the Katy Place Heights PUD Development Plan; approving less stringent screening requirements; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land located in the northwest quarter of Section 23, T48N R13W, in Columbia, Boone County, Missouri, being part of Lot 2 Katy Place Heights Subdivision Plat 1, recorded in plat book 25 page 38 of the Boone County Records.

Beginning at the northeast corner of Lot 2 Katy Place Heights Subdivision Plat 1, thence S 0°39’ 00”W, along the easterly line thereof, 55.00 feet; thence, leaving said line, N 83°28’ 00”W 343.32 feet; thence N 15°45’ 30”E 55.43 feet to the northerly line of said Lot 2; thence S 83°28’ 00”E, along said line, 328.80 feet to the beginning and containing 0.42 acre.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District R-3 PUD (Planned Unit Development).  Hereafter the property may be used for a tree preservation area

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The City Council hereby approves the Lot 3 Katy Place Heights Subdivision Plat 2 CP Development Plan, dated April 13, 2006.  The Director of Planning and Development shall use the design parameters set forth in “Exhibit A,” which is attached to and made a part of this ordinance, as guidance when considering any future revisions to the C-P Development Plan.

    SECTION 4.    The City Council hereby approves a revision to the Katy Place Heights PUD Development Plan, dated March, 2006.  The property is located on the east side of Forum Boulevard, south of Forum Katy Parkway and contains approximately 22.58 acres.  This revision allows for the reduction in open space from 61.4% to 60.9%.

    SECTION 5.    The City Council approves less stringent screening requirements than those set forth in Section 29-17(d)(6) of the Zoning Regulations so that a landscape screen shall not be required along the south property line adjacent to the R-3 PUD zoned tract.

    SECTION 6.    This ordinance shall be in full force and effect from and after its passage.
