     AN ORDINANCE

rezoning property located on the north side of Mexico Gravel Road, along both sides of Wellington Drive from District PUD-2.5 to District PUD-3; repealing all conflicting ordinances or parts of ordinances; setting forth a condition of approval; approving the PUD development plan of Wellington Villas PUD; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 33, TOWNSHIP 49 NORTH, RANGE 12 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, BEING PART OF THE WARRANTY DEED RECORDED IN BOOK 797, PAGE 435 OF THE BOONE COUNTY RECORDS, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

BEGINNING AT THE NORTHEAST CORNER OF LOT 18 OF WELLINGTON ESTATES PLAT 4 RECORDED IN PLAT BOOK 32, PAGE 16 OF THE BOONE COUNTY RECORDS; THENCE S0°45'00"W, 994.98 FEET; THENCE S89°30'50"E, 352.68 FEET; THENCE S0°29'05"W, 59.45 FEET; THENCE ALONG A 123.15 FOOT RADIUS CURVE TO THE RIGHT, 104.23 FEET, SAID CURVE HAVING A CHORD S24°43'50"W, 101.15 FEET; THENCE ALONG A 173.15 FOOT RADIUS CURVE TO THE LEFT, 146.55 FEET, SAID CURVE HAVING A CHORD S24°43'50"W, 142.21 FEET; THENCE S0°29'05"W, 237.17 FEET; THENCE S89°15'45"W, 567.31 FEET; THENCE N1°46'00"E, 435.75 FEET; THENCE S89°14'25"W, 149.98 FEET; THENCE N1°45'55"E, 508.35 FEET; THENCE S88°45'10"W, 399.46 FEET; THENCE N1°48'30"E, 580.11 FEET; THENCE N89°18'35"E, 833.95 FEET TO THE POINT OF BEGINNING AND CONTAINING 22.84 ACRES.

AND COMMENCING AT THE SOUTHEAST CORNER OF LOT 18 OF WELLINGTON ESTATES PLAT 4 RECORDED IN PLAT BOOK 32, PAGE 16 OF THE BOONE COUNTY RECORDS; THENCE N89°40'15"E, 50.04 FEET TO THE POINT OF BEGINNING; THENCE N89°40'15"E, 99.33 FEET; THENCE S0°22'45"W, 213.79 FEET; THENCE S89°15'45"W, 99.73 FEET; THENCE N0°29'05"E, 214.50 FEET TO THE POINT OF BEGINNING AND CONTAINING 0.49 ACRES.

TOTAL AREA = 23.33 ACRES

will be rezoned and become a part of District PUD-3 (Planned Unit Development) with a development density not exceeding three dwelling units per acre and taken away from District PUD-2.5.  Hereafter the property may be used for single-family attached villas with zero lot lines and all accessory uses permitted in District R-1 (One-Family Dwelling District).  The statement of intent submitted by applicant, marked AExhibit A@ is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The rezoning of the property described in Section 1 shall be subject to the condition that a payment of $16,250.00 ($25.00/lineal foot of frontage) toward future improvements to Mexico Gravel Road be paid prior to final plat approval.

    SECTION 4.    The City Council hereby approves the PUD Development Plan of Wellington Villas PUD dated May 15, 2006, for the property referenced in Section 1 above.

    SECTION 5.    This ordinance shall be in full force and effect from and after its passage.
