     AN ORDINANCE

approving the Final Plat of Dakota Ridge Plat 2, a major subdivision; accepting the dedication of rightsofway and easements; authorizing a performance contract; granting a variance from the Subdivision Regulations relating to sidewalk construction; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council hereby approves the Final Plat of Dakota Ridge Plat 2, dated May 5, 2006, a major subdivision located on the east side of Ballenger Lane (State Route PP), south of Mexico Gravel Road, containing approximately 41.33 acres in the City of Columbia, Boone County, Missouri, and hereby authorizes and directs the Mayor and City Clerk to sign the plat evidencing such approval.

    SECTION 2.    The City Council hereby accepts the dedication of all rightsofway and easements as dedicated upon the plat.

    SECTION 3.    The City Manager is hereby authorized to execute a performance contract with William Hugh Tincher in connection with the approval of the Final Plat of Dakota Ridge Plat 2.  The form and content of the contract shall be substantially as set forth in "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 4.    Subdivider is granted a variance from the requirements of Section 25-48.1 of the Subdivision Regulations so that a sidewalk shall not be required along a portion of the east side of Ballenger Lane (State Route PP) adjacent to the proposed Lot 267 of Dakota Ridge Plat 2; provided, that subdivider shall make a payment in lieu of sidewalk construction in the amount of $10,320.00 prior to any building permits being issued for the proposed subdivision.

    SECTION 5.    This ordinance shall be in full force and effect from and after its passage.
