     AN ORDINANCE

vacating a drainage easement and two sanitary sewer easements located within Madison Park Plat 1; directing the City Clerk to have a copy of this ordinance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council finds and determines that certain drainage and sanitary sewer easements, more particularly described as follows:

DRAINAGE EASEMENT B VACATION

A 16.00-FOOT STRIP OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 22, TOWNSHIP 48 NORTH, RANGE 13 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, AND BEING PART OF LOTS 102 AND 103 OF MADISON PARK PLAT 1 AS RECORDED IN PLAT BOOK 39, PAGE 69, ALL OF THE BOONE COUNTY RECORDS AND BEING FURTHER DESCRIBED AS FOLLOWS:

BEGINNING AT THE NORTHEASTERLY CORNER OF LOT 102 OF MADISON PARK PLAT 1, AS RECORDED IN PLAT BOOK 39, PAGE 69; THENCE ALONG A NON-TANGENT 225.00-FOOT RADIUS CURVE TO THE LEFT, 8.00 FEET, SAID CURVE HAVING A CHORD S14°49’ 25”W, 8.00 FEET; THENCE N74°09’ 25”W, 104.14 FEET; THENCE N15°50’ 35”E, 16.00 FEET; THENCE S74°09’ 25”E, 104.14 FEET, THENCE ALONG A NON-TANGENT 225.00-FOOT RADIUS CURVE TO THE LEFT, 8.00 FEET, SAID CURVE HAVING A CHORD S16°51’ 40”W, 8.00 FEET TO THE POINT OF BEGINNING AND CONTAINING 1,665 SQUARE FEET.

A 16.00-FOOT WIDE STRIP OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 22, TOWNSHIP 48 NORTH, RANGE 13 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, AND BEING PART OF LOTS 104 THRU 110 OF MADISON PARK PLAT 1 AS RECORDED IN PLAT BOOK 39, PAGE 69, ALL OF THE BOONE COUNTY RECORDS AND BEING FURTHER DESCRIBED AS FOLLOWS:

A 16.00-FOOT WIDE STRIP OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 22, TOWNSHIP 48 NORTH, RANGE 13 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, AND BEING PART OF LOTS 110 THRU 122 OF MADISON PARK PLAT 1 AS RECORDED IN PLAT BOOK 39, PAGE 69, ALL OF THE BOONE COUNTY RECORDS AND BEING FURTHER DESCRIBED AS FOLLOWS:

COMMENCING AT THE WEST CORNER OF LOT 111 OF MADISON PARK PLAT 1; THENCE N12°22’ 26”E, 113.43 FEET TO THE POINT OF BEGINNING; THENCE N05°35’ 55”W, 16.99 FEET; THENCE N50°03’ 40”E, 7.70 FEET; THENCE S34°57’ 10”E, 344.74 FEET; THENCE S36°47’ 25”E, 337.07 FEET; THENCE S19°45’ 25”E, 97.20 FEET; THENCE S70°14’ 35”W, 16.00 FEET; THENCE N19°45’ 25”W, 94.80 FEET; THENCE N36°47’ 25”W, 334.93 FEET; THENCE N34°57’ 10”W, 329.52 FEET TO THE POINT OF BEGINNING AND CONTAINING 12,360 SQUARE FEET.

are in excess and surplus to the needs of the City and are hereby vacated.

    SECTION 2.    The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 3.    This ordinance shall be in full force and effect from and after its passage.
